The LO is apparently unwell and is seldom in office, and the show is run by these senior staff ladies, one of whome you spoke to. One of these licensing assistants was instrumental in suspending a driver and pulling him infront of the committee for this very offence. Then sending everyone warning letters to everyone to put the meter on regardless of where the journey ends etc. The LO not being in the office is a regular ploy to avoiding answering potentially difficult questions. :cry:

Sheffield has kindly sent me the bylaw on which they rely for the condition in question?

The bylaw is dated 20 Nov 1986 and refers to section 19. b.

It would appear to me at "first glance" that the bylaw is incomplete and at variance with certain sections of the 1847 act. Therefore I would suggest there is every possibility that this section of the bylaw could be successfully challenged in a court of law.

A council can only set conditions of fares that relate to their prescribed distance, there is nothing in this bylaw that mentions journeys that end outside their prescribed distance? In fact the 1847 act is quite specific about fares in that respect, so if the act states a council can only regulate fares within their own area then it would be inconsistent with the act of 1847 for a council to try and regulate fares outside their area. Or for that matter even try and regulate how a contract should be agreed which ends outside the area?

Is the condition worth a challenge? I would say yes, but then again it's not my money. Ask your colleagues to read the February edition of Press Cuttings Monthly magazine, I'll perhaps mention it in that. If you want to distribute some of the magazines in your area we can arrange for that too. If anyone else wishes to distribute any Press Cuttings Monthly magazines then perhaps that can also be arranged?

I now have all the bylaws from that date appertaining to Sheffield, so I shall post them later for your convenience.

Please advise your colleagues of this bylaw and let them know that it was provided by courtesy of Taxi Driver online.

BYELAWS RELATING TO HACKNEY CARRIAGES

STARTING OR STOPPING OF TAXIMETERS


19. The driver of a hackney carriage provided with a taximeter shall:-

(a) when standing or plying for hire, keep the key, flag or other device fitted in pursuance of the byelaw in that behalf locked in the position in which no fare is recorded on the face of the taximeter;

(b) as soon as the carriage is hired by distance or time and before the beginning of the journey, bring the machinery of the taximeter into action by operating the said key, flag or other device, so that the word "HIRED" is legible on the face of the taximeter and keep the machinery of the taximeter in action until the termination of the hiring;

(c) cause the display of the taximeter to be kept properly illuminated throughout any part of the hiring which is during the hours of darkness, these being the time between half-an-hour after sunset and half-an-hour before sunrise and also at any other time at the request of the hirer;

(d) immediately on completion of the hiring cause the taximeter to cease recording but so that the amount of the fare recorded shall remain displayed on the face of the taximeter to permit the hirer to have a reasonable opportunity of examining the same.

Don't think there is any legal requirement to run the meter for a pre agreed fare, however I always do in case the jorney changes or the guy says he wants to go to Chelmsford but he really means a village 10 miles past Chelmsford.

I actually help to run a local on line message board in sheffield and it was as a result of PeteG's post advertising Press Cuttings Monthly on there that I came across your site. Only a few drivers are interested in online forum but those who are seem to keep things active. One collegue has already coppied and pasted your complete message and of course appreciate help given. Unofficially they have indicated that this issue will be looked into so we'll see. :wink:

I can't see the point of having our little forum running in light of TDO's national status but for the time being concentrating on everyday local issues we've decided to keep it going

We can come to some arrangement on distributing the Press Cuttings Monthly mag on the ranks in Sheffield too, so please pm me on that as to how you normally work, cheers.

Ray is still about (if it's the same chap). sounds like him to be involved in something like that. :) Nice fella I agree.
He was at the time involved with the trade association but I think he left that for a quieter life, but he's still about and I'll mention it to him. :wink:

Hi Pete

As for distributing the Mag, I will reply to that PM once I've found an adress to give that can accept delivery and help distribution on the ranks, so may take a day or two.

Congratulations on a belting domain name...! Superb! I also notice you have sheffieldtaxiforum.co.uk... also a good one, but neither seem to be being used as a domain?

If I can offer some advice to help improve your forums performance and exposure on the organic listings it would be to stop using that domain as a framed redirect and to use it as either the primary domain name or as a domain alias... that way your site will perform much better on the organic listings.

No worries with regards to the delay with the address... I will get the PM sent and let us know when you can.
