If your only a driver, your employer is under obligation to supply a shelter for you and that shelter is your car, you can smoke with your door open and one foot on the floor, we all do.
You should e mail a letter to your local paper with the above rules stating that the council are not complying with them, or even the daily record or Scottish sun

I drive and am registered as operator for plate but work on a company radio despatch system. Always assumed this made me self employed but not sure if technically this is the case.

Technically if I stood outside the car and blew all the smoke into the car through an open window they cant do me, but if I sit inside holding the fag out an open window and blow smoke out they can do me in my own car. Mental !!

Unfortunately my MSP was at the forefront of pushing through the smoking ban so don't think I would get any sympathy there. Will keep you all posted with what happens with this as I am 99% certain I will appeal.

We have always had a no smoking rule in all our cabs and buses. We do not permit smoking and order people not to smoke in the vehicles with notices. Most therefore don't, but if they subsequently decide to smoke, the new laws are a little light on what action we can take to enforce it.

If we lean across and pull the cigarette out of their mouth or otherwise try to enforce the legislation doing 60 mph on a dual carriageway, we would potentially be guilty of Section 5 public dissorder or even Sec 39 common assault, driving without due care and attention and so on...

So, the defence is, that we have made every safe and practicable effort to enforce, but our health and safety risk analysis instructs drivers not to undertake any action of enforcement that might prejudice the customer's or the drivers safety. Ergo: Telling a big Irishman who has had a guiness or two; that he cannot smoke, would incite an act of violence Contrary to Section 5 of the Public Order Act. Thus, our course of action is dictated for us:

Do the job, then phone Samaritans later when you are off shift, cos no bugger else is in the slightest bit interested in the fact that we are stuffed up the backside with so much stupid legislation.

Can we smoke on the website?

Trevor,

Thanks for your query of today on the smoke free situation and where we
are up to. All licensed vehicles will need clear signage that has a
specified 70 mm diameter " smoke free" sign on it. This is a mandatory
requirement under the Health Act 2006- no exceptions- imposed by Central
Government. Such signs/symbols can be obtained free via
www.smokefreeengland.co.uk but they will apparently not provide large
numbers- it requires individual applications.

As a pro-active Council Sefton TLU has decided to deal with this
problem in the timescale allowed by ordering signs that will stick on
the top of the inside of your rear passenger side windows facing
outwards and which will be available from us, free, from the 18th June-
well in advance of the 1st July 2007.We will distribute via
operators, trade reps etc as well as at the One Stop Shops.

The Health Act 2006-derived legislation specifies that drivers face
prosecution if they allow smoking and passengers and drivers face
prosecution if they smoke so the signs I have requested have the
mandatory symbol, " IT IS AGAINST THE LAW TO SMOKE IN THIS LICENSED
VEHICLE" followed by the Sefton logo. This is so drivers will be able to
say along the lines of " I can't allow you to smoke and even I cannot
smoke now as you or I will be given a fixed penalty or fined and yes
the council are enforcing it".

Hopefully this will ease the initial situation until people get used to
it. Finally I have attached the sample of the sign so you can see what
you will be getting.

I just wonder how much abuse the idiots who are going to enforce this will take before they pack in, they can only call the police if they are verbally or physically abused, and I bet they will be more than 1 who will end up getting a kicking from someone on the street, or a big burly truck driver.
I can see it now in Newcastle, I am giving you a fine for smoking, Geordie says up yours as he sends in a right hook. :shock: :D :lol: and that can and will happen not just in that city but all of them.

One thing is for sure skipps we will not see the fag brigade after about 11 at night as they will be filling their pants.They will try and hit the dayshift lads first.Prohibitation makes people angrier and they will be coming out of clubs and pubs with about 3 fags in their gob at once :-| :-| :-|

What about the "no smoking in a substantially enclosed pubic place" I'd say a car with sunroof and windows open wasn't substantially enclosed.
And wont they need pic's? like traffic wardens?

Going a stage further (and i smoke, yes it's a filthy habit, i know) whats the difference in smoking outside your window (my fags/smoke never enter my car) and someone standing at the side of the car smoking.
It's easier to just get out if you want one.

Up here in edinburgh im sure we have about five dedicated smoke wardens.And yes the dayshift might be unlucky. But you never see them at night!And don,t worry about the police they dont give a rats ass!!(better things to do and all that)!!! The amount of people who smoke in their vehicles up here is unbelievable!!!near enough everyone complies in the pubs etc!but if your on your own in your taxi,truck,etc lets face it who the hell,s gonna stop you!!!!

ive only ever seen two in dundee but as mikey says the dayshift get hammered,but then come nightshift the new enforcement officers in dundee take over, a lot of cabbies sitting on the bingo halls were caught out first week they were emlpoyed, the recent ashtray checks were done on a friday night
