question... if a hackney picks up a fare in another district..... legally what is he guilty of. |

I guess it depends how the taxi got the fare. If pre booked, as you well know, not guilty of anything |

Up here: Operating a taxi without the appropriate licences, contrary to Section 21(1)(a) of the Civic Government Scotland Act, 1982. South of the border, not a clue. |

Bloody good question!! I'll have to have a look and a think about that one for a precise answer. But rest assured, I'll be back, in a day or two with what I think is the precise answer. Question; is there any case law on this particular misdemeanour? I think not. And if not, then until now it's not an offence as no one has ever been convicted. Unless anyone else has the wisdom and know different? |

If the job is off the path then picking up without a license, if off the radio then nothing. |

if its a flag down then the hack has committed the same heanious crime that all hacks wish to accuse private hire vehicles of - i.e. plying for hire, indeed outside its own LA a hack is only a hack in the imagination of the driver ......... or TDO hacks nationwide.....

There is a reason for the question..... we all know that it is illegal for private hire vehicle to pick up off the road..1976 Act.... which nowadays means that drivers are being prosecuted and have points fixed to their licence... but the same Act does not apply to Hackney's imo ... now years ago if a Sefton hackney was prosecuted in Liverpool it would be for breaking a bylaw... which would be a fine..... now they seem to think a hackney driver should also have points on his licence.... I am wandering which act or law covers this... |
