A friend has asked if I would post for him.

Basically he bought a car on finance and over stretched himself given the time of year. Unfortunately while sitting at trafic lights last night a van ploughed into the back of him and pushed him into the back of the car in front. Basically his car is a total loss which will eventually be paid once the Insurance Companies decided liability etc. As his car hit a car in front his insurers are refusing to allow a hire car due to him be at fault for this although not at fault as hit from the rear

Well to cut a long story about his personal circumstances short - he basically wants the insurers to repay the loan on the car and end it there. BUT ... and there always is one - he needs a car that he can work given the rather messy state of his circumstances at the moment he is looking for somewhere that he can get a cab on Finance or Rent to Buy that won't look into his credit history too far and won't charge stupid amounts of interest. Due to local legislation he needs to purchase a brand new WAV. I don't think he's got a chance and have offered a 50's drive or suggested PH but I said I'd ask and thats what I'm doing?

The mistake he is making is dealing with the insurance company himself he should be using a solicitor that specialises in Taxi or private hire related accidents, most of which will supply him with a vehicle, any good solicitor would be directing any claims made by the person in front to the insurers of the person behind,

There seems to be a slightly differing opinion of witnesses - he says the car hit him from behind and then he hit the car car in front; unfortunately for him a witness says that he hit the car in front and was then hit from behind! Although another cabbie is backing him up saying that it was very close but he was definately hit form the rear first. Theres a big PI claim being launched by the front car

That PUT"S a different reflection on it, need I ask did he have fully comprehensive insurance..

A vehicle stopped at traffic lights with the handbrake on only needs a slight shove to move it (handbrake isnt like your foot on the brake where all 4 brakes are being used)
He must contest the insurance co's decision saying it was his fault, they'll give in eventually.

Ain't there some law to say you have to be fully comp if your cars on finance.

Insurance companies have to deal with claims on the basis of probability, be honest, which is more likely to happen.

1. The lights were on red, the car in front stopped, I stopped, the car behind ran into the back of my car which then made my car hit the one in front.

2, The lights were on red, the car in front stopped, and I was travelling too fast and failed to stop in time and hit the car in front, the car behind had no time to stop and hit my car.
