| Post subject: | Soiling charge |
What is the law regarding the Local Authority set soiling charge ?, if somebody refuses to pay where do you stand, is it a police matter or is it a civil matter. The police tell me its a civil matter but if its set down in the tariff of fares then surely its making off without payment. |

In the office where i work we have a charge of about £50 if someone is sick in the taxi, however, one of the drivers says that you cannot make someone pay as its not legel to charge them. I dont know if this is true but we still charge them if they are sick. One driver was on a fare and on his way to drop a girl off and she pucked everywhere and before he could stop she pucked again all over him. He stopped at her house where she refused to pay and ran into her house. The driver told her friend that if she did not pay within 5 minutes he would call the police, after 5 minutes he called the police and after he had finished the call another taxi from another firm turned up to take the girl to another address! The police did turn up and told the girl that she would have to pay the second driver the call out, and she would have to pay for being sick in the taxi. She did not have the money on her so the police follwed her in the sick taxi to the cash machine where she withdrew out the money. The driver wanted £100 so she had to pay him £100 plus the fare which came to about £110 on top of the call out fee of the other driver which was about £5, expensive night out for her! Personally i would prefer for no one to be sick in my car as his car stuck for about a week afterwards and he had lots of complaints. A bit long winded this post but as you can see, the police will help in these matters which took me by surprise!!! |

it all depends on which police turn up!! some will help,others will say "civil matter" but few times that i have called police they have been helpfull! |

I think it's a civil matter.

ours is worded Fouling of Interior... For alcohol induced fouling, or in all cases, where the night tarrif applies. £27 |

Our local newspaper informed us that anyone urinating or being sick in the street would be given an £80 on the spot fine, so if the police are patrolling near by it would be cheaper for them to open the door of a waiting taxi throw up and then pay stinky pete or any other driver £27 and legally it would seem to be ok, what a strange world we live in |

I could charge £40. But then I would have no reason to, as I only carry the good guys.

The "soiling" charge in Plymouth is £50 but it's dificult enough getting the fare off some people let alone that.
