Do we legally have to carry a first aid kit, I was under the impression that the first aid kit was for your own use, and that you could be prosecuted if you administered first aid to a punter, if something went wrong during treatment

It’s a condition of license in most authorities. However I have a feeling that the majority of authorities will probably stipulate both a fire extinguisher and a first aid kit. All we need now is a condition allowing us to carry both a nurse to administer the first aid and a fireman to operate the fire extinguisher.

We have to carry a Fire extinquisher but not a First Aid kit.

But the advise we have been given by the Frire Brigade is get out of the car and phone the Fire Brigade

With todays compensation cultre if you are'nt first aid trained and you attach a plaster to someone who is alergic you'll be sued.

Still councils know best!

I think if your LA insists on a first aid kit, then you will be covered if you mess up doing your best to help someone.

If anything you could get done for not helping someone by doing your best, as we all have a 'duty of care'.

I asked my LA about the use of the first aid kit and fire extinguisher that we must carry. The first aid kit is there to be used by a person trained to use it if one is present. The fire extinguisher is to be used to assist passengers to get out the vehicle in the event of a fire, ie try to keep the flames away from the passenger whilst they get out of the vehicle but for christ sake don't get anything in their eyes or you will be sued again. If one of your passengers cuts themselves I would guess that it would be ok to offer them the use of the first aid kit to use themselves.

Yes the first aid kit is a condition of licence, and a fire extinguisher, but the legality of using the kit was brought up at our association meeting, but none of us where sure if we could be sued for administering first aid,If it went wrong,
Most owners and drivers have been through first aid training with Borders college, along with other course's that are also a condition for new licence applications.

I put a case on TDO some time ago which brought into question the duty of care to offer assistance to your fellow man. You may find that if you refuse to help or assist your fellow man then you may be breaking the law. I would expect that doubly applies in respect to the duty of care one owes to ones passenger.

I forgot to mention about the duty of care JD we did discuss this at some length and we know that we are responsible for the punters when they are in the cab, but we where still unsure what the outcome would be if the chit hit the fan

I'll try and dig out that particular case in respect of duty of care, where duty to ones fellow man was one of the pivotal points.

Although on the surface, the non use of a first aid kit might seem reasonable in light of insurance negligence, I have a feeling that the courts might take a different view and weigh the application of a plaster as not carrying the same burden of negligence as that of providing accute medical assistance.

Well the legality of carrying one depends on each LA.

I think the conclusion is that unless you did something malicious then you probably wouldn't suffer any consequences from using a first aid kit in good faith.

Thanks for the info JD and TDO, About 19 years ago, just as finished my shift, I went into a fire and pulled a guy out of his house, even though he was badly burnt he survived, I also single handed, evacuated 32 others from my block of flats at 4am in the morning, and if it was not for my army first aid training some of them could have died.
Would I do it again, yes I would as its a natural instinct
