How do Berwick "Plate by post" when they cant possibly check a HC meter is fitted, or do they not require a meter?... |

In this section and section 48 of this Act, the “appropriate period” means a period of twelve months or such shorter period as may be prescribed. (2) Subject to subsections (3) and (5) below, the motor vehicles to which this section applies at any time are— (a) those first registered under the [1971 c. 10.] Vehicles (Excise) Act 1971, the [1962 c. 13.] Vehicles (Excise) Act 1962, the [1949 c. 89.] Vehicles (Excise) Act 1949 or the [1920 c. 72.] Roads Act 1920, not less than three years before that time, and (b) those which, having a date of manufacture not less than three years before that time, have been used on roads (whether in Great Britain or elsewhere) before being registered under the Vehicles (Excise) Act 1971 or the Vehicles (Excise) Act 1962, being, in either case, motor vehicles other than goods vehicles which are required by regulations under section 49 of this Act to be submitted for a goods vehicle test. (3) As respects a vehicle being— (a) a motor vehicle used for the carriage of passengers and with more than eight seats, excluding the driver’s seat, or (b) a taxi (as defined in section 64 (3) of the [1980 c. 34.] Transport Act 1980), being a vehicle licensed to ply for hire, or (c) an ambulance, that is to say, a motor vehicle which is constructed or adapted, and primarily used, for the carriage of persons to a place where they will receive, or from a place where they have received, medical or dental treatment, and which, by reason of design, marking or equipment is readily identifiable as a vehicle so constructed or adapted, subsection (2)(a) above shall have effect as if for the period there mentioned there were substituted a period of one year. |

Outdated AOP can be such fun... define a taxi (3)In this section “taxi” means a vehicle licensed under section 37 of the M1Town Police Clauses Act 1847, section 6 of the M2Metropolitan Carriage Act 1869, [F2section 10 of the Civic Government (Scotland) Act 1982] or any similar local enactment. ----------------------------------------------------------------------- 37 Hackney carriages to be licensed The commissioners may from time to time licence to ply for hire within the prescribed distance, or if no distance is prescribed, within five miles from the General Post Office of the city, town, or place to which the special Act refers, (which in that case shall be deemed the prescribed distance,) 38 Every wheeled carriage, whatever may be its form or construction, used in standing or plying for hire in any street within the prescribed distance, and every carriage standing upon any street within the prescribed distance, having thereon any numbered plate required by this or the special Act to be fixed upon a hackney carriage, or having thereon any plate resembling or intended to resemble any such plate as aforesaid, shall be deemed to be a hackney carriage within the meaning of this Act; and in all proceedings at law or otherwise the term “hackney carriage” shall be sufficient to describe any such carriage: Provision always, that no stage coach used for the purpose of standing or plying for passengers to be carried for hire at separate fares, and duly licensed for that purpose, and having thereon the proper numbered plates required by law to be placed on such stage coaches, shall be deemed to be a hackney carriage within the meaning of this Act. |

btw, do vosa acknowledge Compliance Certificates (as issued in place of MOT's at one time) as a bone-fide document of equal legal standing? last time i had one the post office accepted it for taxing purposes for a HC, but surely the new style MOT procedure (started 2006?) only issues pukka test certificates, my "compliance" test saturday didnt include a brake or emission test... |
