I read somewhere on here recently about "The Fraud Act" and the sections of "The Theft Act 1978" that were repealed as a result. I am particularly interested in the sections regarding "making off without payment" or "bilking." I can't now however find the article in question in which JD clarified the current situation and was hoping that somebody (or maybe JD himself) could assist.

I remember thinking at the time that it would be useful to print off a copy of the piece and then promptly forgot :? and now less than a week later I've been asked about this and the stance taken by the local gendarmerie who are unclear on the legal status, depending on whom you speak to. :? :?

You may have been thinking about the Theft Act 1968 and the inadequacy of the provisions there which led to the passing of the 1978 Act?

There have been several threads on this, and the most recent I can find is:

http://taxi-driver.co.uk/phpBB2/viewtopic.php?p=70109

There are a couple of posts by myself about the origins of the bilking offence.

An earlier one with a few real life cases is at:

http://taxi-driver.co.uk/phpBB2/viewtopic.php?p=59391

If you need to find anything earlier threads try using the search facility to find "bilking", "1978", "theft" or whatever.

The Fraud Act 2006 repeals a lot of Theft Act 1968 and 1978. Use the link below and it will tell you which bits. I think it makes it easier for the old bill to prove bilkings and the like.
