I do indeed.

I'll exchange it for the names of all the local Taxi associations affiliated to the NTA. Is that a fair deal?

JD

I cannot do that JD, it would be a breach of trust.

I can advise of 100 member associations though.

The each case on its own merits aspect.

One of the guys in Carlisle wants to be 100% certain any future policy that brings in an age limit (on vehicles) will offer him discretion.

I told him I knew of a court case and thought it was on my PC, it wasn't.

The thing about the rauf case is that if they had gone through the proper process and appealed to the magistrates court then the decision might well have been different?

In what respect, wasnt there something about a letter not indicating that the LA was shutting its ears totally?

At judicial review the court will only look at the decision being lawfull. The magistrates court would look at the decision as a whole if they thought it was too stringent then they could ammend the decision regardless of the councils policy. As was the case in respect of the limo license appeal.

Like magistrates in Blackpool permitting PH operators to accept block bookings for PHV's? Against the wishes of the LA.

If you wan't to read a good case have a look at the Chester crown court case I'm about to put up. It relates to one or two things that we have been discussing lately especially the pace interview and the relevance of saying nothing when questioned. Also in respect of reversing a councils decision to revoke a license. Amongst other things.

In fact every one should read this case.

JD
