"the departments view, not legal advice", funny how this statement crops up on almost all DoT documents and booklets, no wonder there are "grey areas". I bet if you asked the DoT what day it is they would NOT reply Monday, more like, given consideration of all relevant information and notwithstanding any decision that may or not be made by a court of law today will fall somewhere between Sunday and Tuesday, this would depend of course on which calendar the relevant information was being assumed to be correct :lol: :lol: :lol: :lol: :lol: :lol: all persons who may wish to rely on this information should seek independent legal advice and not just rely on information contained in this booklet. ](*,) ](*,) ](*,)

I agree, but civil servants are not meant to give legal advice.

But there guidance, rightly or wrongly, carries a fair bit of weight in the courts. :wink:

I like this bit from the DfT reminding us of the 7 day sham contracts perpetuated by the majority in the unlicensed limo trade. If anyone writes to the DfT before the 28th Sept deadline, please consider reminding them that there is also a sham going on in respect of wedding contracts and that this loophole should now also be closed to accommodate only those persons who operate bone fide wedding contracts.

25. Some stretched limousines may fall within the definition of PHV and may have been relying on the contract exemption. However, the points made in paragraph 11 are of course relevant.

"In particular, it should be noted that the contract exemption cannot be correctly relied on by services which involve a series of one-off hirings lasting a day or perhaps just an evening - as seems to be the case for many services provided by stretched limousines."
