I think they should retitled this consultation..... it should be.... The Law Commission's investigation into totally stupid and under-trained licensing officers across the country... because let's face it.... that is what it really is......: Oh and did I forget to say... . overpaid... :D

Have not the LC already stated that rescriction are illegal under EU law?

No, I think that was Sussex

There are certainly aspects of EU law that could be used to mount a legal challenge, but I couldn't really see the LC stating an opinion on the relevant law in the way that you suggest.

Although if you could point me towards precisely where the LC state what you suggest they did then I'd be very pleased to be proved wrong :D

I'm mistaken they haven't, thought I readit somewhere....

However I stand by my point that charging the same license holders in the same city differing amounts based purely on their vehicle would be challenged and won.

Why is it that some councils restrict and some also re-restrict

Political will, plain and simple. If a big boy came into town with cash, influence and a desire for de-restriction, you would be tomorrow.

Amazing how ppl still think the system is for them....

Edit....individual influence is also why Brighton is still restricted.

Under current law, certainly, but of course the LC project is all about suggesting new law.

The market intervention you suggest is anti-competitive (illegal) Simple as that. The LC are hardly going to recommend something that is unlawful.

In fact the LC is proposing just what Edders suggested, ie fees incentives to purchase WAVs, or whatever.

See section 18.6 on.

I will have a rather large waiver that will be one for the chop. Yes they can 'make' New laws but to go against EU law would be rather foolish imho. It would also be challenged on its was through parliament.

No disrespect but you clearly know nothing about how local government works.....aside from where this alledged mess is......its hilarious that you think councillors have investigated.......priceless!!!!

I've sat and watched councillors vote yes for something, then ask the chair what they voted for!!!

Before you come out with, "its different up here." No its not, the political class are the same all over, which is why this country is in the state it is.

I never said "its different up here" i dont think it is.Why do they restrict then ? Why have places that have deristricted gone back to restriction ? Why have other countries that have deristricted( netherlands to name one seen the "mess" it caused ? So maybe i dont know how local councils operate ? Clearly you do ! You carry on,you seem to know it all

It's simple, its polical will....plain and simple.

Why does any council do what it does. Whoever has the largest interest!!!

The whole political class, both local and central are corrupt to the core, always have been and as long as the masses remain willfully ignorant will remain as such.

I'm still astounded that ppl still think the political class give two hoots about them.....It isn't about knowing everything. Its about taking your mind out of it cognitive dissonance state and seeing things for what they really are......
