We have received an Email today from our source close to Westminster, “TheMouseInTheHouse” tells us the report from the commons select Committee is almost ready and MUST be published online by July 19 this year. This is obviously when Parliament rises for summer recess. This would follow the same path and time scale of last year’s Equality bill. We would expect this bill to clear Commons before Xmas 2011 and clear Lords before March 2012. The Act can then be ratified around October 2012. We are told the report recommends the repeal of section 16 of the Transport Act 1985. This in effect will de-limit Hackneys nationwide. The purpose is to remove the burden of bi-annual market research surveys to limit the number of hackneys on the road. “TheMouse” further alleges that a better way to contain numbers is by quality restrictions. To that end it is proposed that all new Hackney and Private hire vehicles being licensed for the first time will be required to pass Euro 5 emission standards. Further speculation of the report is not needed. “TheMouse” promises us we will have a sneak preview before publication. However if you were toying with the idea of selling, do it on the “Hurry Up”. To be fair its onl;y the larger metropolitan areas will be affected surely ? the majority of rural and district councils in the country allow their areas to be flooded out with hackneys anyway Could this eventually lead to the Conversion of PH to Hackney and a severe shortage of rank space in some areas ? |

16 Taxi licensing: control of numbers. E+W+S The provisions of the Town Police Clauses Act 1847 with respect to hackney carriages, as incorporated in any enactment (whenever passed), shall have effect— (a)as if in section 37, the words “such number of” and “as they think fit” were omitted; and (b)as if they provided that the grant of a licence may be refused, for the purpose of limiting the number of hackney carriages in respect of which licences are granted, if, but only if, the person authorised to grant licences is satisfied that there is no significant demand for the services of hackney carriages (within the area to which the licence would apply) which is unmet. http://www.legislation.gov.uk/ukpga/198 ... iew=extent |

BTW if section 16 was repealled in full, wouldn't we be back to where we were before this act? i.e. Councils imposing numerical limits without having to show there was no unmet demand? |

No, because the Transport Act says no, unless section 16 applies. So no section 16 opt out, no restrictions. |

So all the PH go hack and we live happily ever after ye right. It will become dog eat dog survival of the fittest especially in the all WAV areas where folk will now have a choice of vehicles |
