COUNCIL IN U-TURN ON TAXI ACTION
12:20 - 22 January 2004
Plymouth City Council was today forced to withdraw threats of legal action against drivers working for an unlicensed taxi firm in an embarrassing U-turn. The authority has been forced to give an undertaking to a High Court judge not to withdraw the badges of cabbies at Silverline.
Licensing chiefs have also vowed not to threaten drivers with action through media interviews.
Silverline will now take legal action to win compensation for damage to business, with the cost of lost business estimated at £1,260 a week.
The council agreed to meet the costs of yesterday's hearing in London.
Company lawyer Michael Hayman said it was a 'humiliating climbdown' for the city council.
The authority gave an undertaking before the High Court not to take action against drivers or director Lawrence Brown, who is applying for the operator's licence. The council promised to hold off until Mr Brown's appeal against the council's refusal of the licence is heard in crown court.
Mr Justice Stanley Burnton approved the settlement two days after an interim injunction against the council had been granted.
A district judge sitting in magistrates court initially refused the appeal before Christmas.
Council legal and licensing chiefs responding by telling the Herald it would shut the company down - because it is against the rules for a taxi firm to run without an operator's licence.
