but surely if you book via one of those ticket machines it is illegal. after all they cant know your name and destination .

Indeed they can't, that's why they therefore can't be illegal.

In your neck of the woods PH bookings can only be made by telephone or in person at the "taxi" office. Mind you you can still order a cab that you can smoke in according to the council. Actually that is for Brighton and Hove. I don't know if that is your manor with you have 1066 country in your avatar. This would sugest Hastings. Well in Hastings the conditions state that the booking must include the pick up point and destination and it must be taken in writing, not by some automated machine.

I suspect there are 100s of 1000s of booking each day in this country that don't adhere to the principles you mention above, and I have never seen a successful prosecution.

In relation to this issue the actual act doesn't lay down any rules other than allowing councils to do their own.

The large data firms have had autobook for over 10 years now, and again I have never seen a successful prosecution.
