Are there any grounds for him to appeal the sentence?

Insurance companies are very strict |I had a driver working part time but in his regular day jab he got caught using his mobile while driving then a 3 point penalty. The insurance whacked 20 percent surcharge onto the premium for that !! even though it was not whilst driving the taxi

I'd have thought your insurance would have had legal expenses cover to cover authorised drivers for defending such claims?

Read the comments at the end of the story.

Why did the driver get charged?? It seems like we've got to have eyes up our backsides now and look out for p!ssed pedestrians who are a sleep in the middle of the road.

I'd appeal this to the Crown Court if I was the driver.

CRETIN HE PLEAD GUILTY YOU BURKE REMEMBER HES A CAB DRIVER IE NO BRAINS JUST LIKE YOU YOU PILLOCK.

AND IF HE COULD APPEAL ANY IDEA HOW MUCH IT WOULD COST ??? YOU MUG #-o #-o #-o

COURSE IF HE WERE IN A UNION AND HE HAD A CASE IT WOULD COST HIM ZILCH ...............TOO COMPLICATED FOR YOU I KNOW #-o

but if he pleaded not guilty and was convicted it would be far worse and could be £1,000.

Fines are basaed on income.

He would have had to have been earning £1000 a week to get that level fine.

No matter what he pleaded.

I know that and you know that, in fact after reading this forum, most people will know that but unfortunately this chap believed what the police told him and is now paying the price.

Stop being a pillock, your starting to sound like a right wing loon.

Even less informed people deserve to be treated fairly.

The insurance company have said he can stay on the policy until renewal and they will re-assess the position then.

Common sense prevailed there on behalf of the insurance company. If he was any risk they would've said "no" straight away. What the position with the Council?

He has informed them in writing and we will have to wait and see what they have to say. The problem may well be that if they call him in for a hearing he may well not think it worth it to take representation with him.

Make sure he takes representation in with him no matter who it is. If I was on the committee and this case was to be heard there'd be nothing to consider, the driver didn't commit any offence, there was a drunk passenger in the middle of the road laid down a sleep in the dark. He too bad advice off the Police which has left him with a driving charge. I hope he listens to someone.

Normally I would offer to go with him but if I get elected on Thursday I won't be able to.
