The penalty is in the illegality of the offence. The private hire driver wasn't insured to pick up passengers off the street.

If a hackney carriage driver from Carlisle picked up a passenger off the street in Manchester then I assume the courts might place him in the same position as the private hire driver? However, you should notice that I did offer up the word "might" in my previous post.

Would this also apply to a hack illegally plying for hire in an other area?

For the purpose of public hire a hackney carriage is only licensed to ply for hire within its own area. If it were to ply for hire anywhere else, it commits an offence.

I don't have to tell you the difference between public and private hire so why don't you get to the point and hit me with the punch line regarding the Wilson case of 1993 or whenever it was? lol
