I was under the impression that both driver and passenger are fined but I wasn't aware it is two grand, in fact I thought it was only 50 pounds.

I think it is £50 for the person doing the smoking at £2000 for the person permmiting the person to smoke.

Stinky, I think you'll find that there is no need for photo evidence. A written statement from the councellor will suffice, read in court or called as a witness. Who do you think the magistrates will believe? I'd pay the fine, it will be a lot less than being found guilty at court.
