I think he gets his ops license first, and then puts on what he likes as far as it has got approval by the DVLA i.e. a tax disc.

The act says;

(1) .. in this Act “public service vehicles means a motor vehicle .. which –
(a) being a vehicle adapted to carry more than eight passengers, is used for carrying passengers for hire or reward; or
(b) being a vehicle not so adapted, is used for carrying passengers for hire or reward at separate fares in the course of a business of carrying passengers

Which basically means that anyone can run a fleet of 100% tuk tuks or even 100% Skodas as PSV.

The saving grace is the seperate fares issue, and when VOSA actually get around to enforcing the law of the land, it might cause a problem or two for the limo mob.

That section just describes the types of vehicles used for PSV, its the type of operators license that defines what you can run and what you can't run?

JD

Quite, which is why he got his ops license without having to declare his vehicles.

Once he got his license he then got the vehicles.

It appears to me he's running under the flexible service scheme, which is very similar to a localised private hire scheme.

Indeed he was this year, but last year he was running a timetabled bus route.

Hence the big fat juicy fine. \:D/ \:D/ \:D/

It's his car bought and paid for.

I also think Ferrari have deep enough pockets to get away with this.

There are apparently some legal presedncies on this sort of thing. Rolls Royce have had some success in forcing people to remove their logos from cars.

I think you will find that Dan puts it up for sale on ebay regulaly. He gets thousands of hits to his website from the advert which helps his google ranking.

There is no case. The Ferrari is a Ferrari . But it is not a ferrari limo as ferrari dont make limos, However it is a stretch Ferrari, And that has been amended on our paperwok.

However I wouldnt of minded Ferrari allowing me to Re-Brand there product.

Ferrari Limo is a promotinal Tool that does promo work , it also does the odd wedding, for £700 per hr its isnt run on PH or restricted.

As said its on e-bay for sale , £9 for 28 days classified add average 15000 hits to the website , For those that know the net it helps with our website rankings. But if someone wants to buy they can.

Thanks Dan

Hi Dan

Last I heard Ferrari were making all sorts of threatening noises about copyright infringement, demanding that the Ferrari badges were removed, not to be referred to as a Ferrari again etc etc.

Has this now been resolved?

Like the motor BTW 8)

A PSV driver can charge for the Vehicle hire as a Whole or Divide the Cost equally amongst its occupants, it is the Passengers Choice of how they raise the money similar to Private Hire eg: One can pay or they can all kit together...it only becomes Chargeable as Seperate fares if its a Registered Regular route..Eg a Bus service or if its a Taxi Bus.
