A Private Hire driver lost his license after appearing before the City of Edinburgh Coucils Regularity Committee for illegaly picking up in the street.

Would he not be breaching the licensing conditions that his badge/Plate was issued under and therefore the council can act?

Licensing boards have more power than you think. Be it licenses for Taxis, Pubs, shops, super markets, gambling, HMO's, personal licenses for many things, there are a lot of licenses issued or taken away by council's licensing boards.

Well the fact that a PH driver did loose his license means there is some sort of enforcememnt in place and the message will be out there that more will loose there license if they disobay the rules, same goes for all other types of licenses.

The council has now in place License Standard Officers (LSO's) for the pub trade and they will be touring licensed premises and low a behold any one flouting laws.

Just for the record, Scottish Licensing Boards have no jurisdiction over taxis, rather they deal with Liquor and Gambling. No illusion eh?

If they can then why do we need courts? However if a council officer made a test purchase and the license was revoked on the evidence of that officer then one can understand why but this approach would be a first wouldn't it because when has it ever been done in the past? Perhaps the chap admitted the offence in which case he made it easy for the committee to declare him not a fit and proper person. How long before the appeal? Regards JD

Different councils work in different ways and the fact is that taxis come under licensing boards. The City of Edinburgh Council has a Licensing Board which deals with Liquor and Gambling and a Regularity Committee which deals with all other types of licenses. Some of the smaller councils just have a Licensing Board which deal with all sorts of Licenses. The Regularity Committee has a seperate name but still deals with licenses.
