Post subject:  Flagging down a P/H
Hi folks,

Had an arguement with a P/H guy tonight about him takin flag downs, the

question i would like to ask is: If a private hire car is insured as a private

hire and he takes a flag down and has an accident with his flag down hire

on board, Is he and his passangers insured??

We have been told in Dundee that the passenger would be covered but the car and driver would not.One high ranking police officer told me recently that a private hire would be covered under third party.When i told him that if that was the case the taxis should just have third party insurance he just about jumped out of his seat and quickly retracted his statement.If divisional commanders don't know the law what chance do we have.

he is not insured its that simple no insurance company would pay out and the law states that he has to be pre booked.
if you have his plate number report him

I don't think there is any legal requirement to have fully comp insurance.

You are wrong there,when i ran a white plate i had full public liability insurance,this is included in the premium.This is why you get taxi/ph insurance and not run the car on a normal policy...hth

And as for the matter of insurance if you pick up illegally,the passengers are always insured.......

NO. ALL PH JOBS MUST BE PRE-BOOKED. ANY OTHER JOB TAKEN IN ANY OTHER WAY INVALIDATES YOUR INSURANCE.

His passengers yes, him maybe, his motor no.

My opinion is that the insurance would possibly pay out a third party claim to passengers or anyone else. The drivers claim for payout would fail. He would possibly face recovery action from the insurers for sums they have paid out to third parties and the insurers would try to involve the police.

He would lose a prosecution for driving without insurance and would thereafter be unable to obtain insurance at reasonable rates. If there's one thing the insurance companies don't like, it's driving without insurance. Different insurers will view different offences in different ways. All will view no insurance the same way.
