POST TITLE: Civic Government Enforcement Officer
POST ID: CS/LR/0115
GRADE: GRG
LOCATION: Renfrewshire House, Cotton Street, Paisley
REPORTING TO: Assistant Managing Solicitor (Licensing)


PRINCIPAL ROLE:

1. To enforce the statutory provisions, licence conditions and policies connected with all
activities licensed by the Council in terms of Parts I and II of the Civic Government
(Scotland) Act 1982 and other relevant legislation.

2. To enforce compliance with the requirements of the Smoking, Health and Social Care
(Scotland) Act 2005, and any Regulations made there under, as they relate to taxis and
private hire cars.

The post will include evening and weekend work.

Key tasks for which the postholder will be responsible:


To monitor compliance with the provisions of Parts I and II of the Civic Government (Scotland) act 1982 in relation to taxi and private hire operators and drivers; second hand dealers; metal dealers; street traders; public skin piercing and tattoo parlours; entertainment establishments; late hours catering establishments; window cleaners and other such activities as may in future be licensed under the Act, or other relevant legislation except for those activities which enforcement is the responsibility of other Council departments.

To monitor compliance with conditions and any associated Council policies or other relevant legislation attached to licences issued for the above activities.

To carry out checks on taxis and private hire cars, meters and drivers, and if considered necessary, suspend licences in terms of Section 11 of the Civic Government (Scotland) Act 1982.

To investigate complaints in relation to any of the activities listed at 1 above or any other relevant complaint and to report to the Assistant Managing Solicitor (Licensing) and/or Strathclyde Police if necessary on such complaints or contravention of licence conditions and/or the Civic Government (Scotland) Act 1982.

To prepare reports to the Regulatory Functions Board on enforcement issues as and when necessary and attend meetings of the Regulatory Functions Board to present reports.

To prepare evidence and statements for the Procurator Fiscal and attend court as and when necessary to give evidence on behalf of the Council.

To visit taxi ranks, sites and premises as appropriate to ensure compliance with the Civic Government (Scotland) Act 1982 and other relevant legislation.

To carry out enforcement duties associated with the Smoking, Health and Social Care (Scotland) Act 2005 and regulations made there under as relative to Renfrewshire licensed taxi and private hire cars, including the investigation of complaints.

To issue fixed penalty notices for contraventions of the Smoking, Health and Social Care (Scotland) Act 2005 and Regulations made there under as relative to Renfrewshire licensed Taxis and private hire cars.

To undertake intra and inter departmental liaison when necessary, and to liaise with elected members, licensees, the public and outside bodies and agencies as required.

To prepare weekly work plans in advance, in consultation with the Team Leader (Licensing) or other officer nominated by the Assistant Managing Solicitor (Licensing).

To maintain records of visits, action taken and outcomes.

In respect of those categories of licence other than for taxis and private hire cars, to ensure that the requirements of each licence and Council policies are adhered to by the licensees and to report thereon to the Assistant Managing Solicitor (Licensing).

To carry out such other appropriate duties and responsibilities as are required from time to time by the Assistant Managing Solicitor (Licensing).

To adhere to the Council’s commitment to Health and Safety and maximising employee attendance
