Unpaid Work & Curfew forJames Duerdin North Sefton Magistrates' Court (Southport) 26-10-2009 -------------------------------------------------------------------------------- James Duerdin – aged 58 of High Park Road, Southport, Merseyside 03/09/09 – Charged that he had in his possession an offensive weapon, namely an axe, in Kensington Road 03/09/09 - Charged that he had in his possession an offensive weapon, namely a Stanley knife, in Kensington Road Guilty Plea entered. At 9pm Police on Patrol stopped the vehicle being driven by the defendant, a Skoda taxi. They said that they had received information that he might be in charge of an axe, under the seat. The Defendant said “yes he had an axe and it was for his own protection in case he had problems with four youths getting into his cab’. On the floor, in a tub containing coins, an axe with a rusty head was found. The defendant said he would only use it in self defence. When asked if he had anything else, he produced a Stanley knife from his pocket, saying it was in case 4 lads started causing trouble. He said he had never used or threatened anyone with either of these weapons. Mr Halliwell said that it is very sad to see a gentleman, who from leaving school at 16 has worked all his life, before the Court facing such serious charges. He had a short handled, rusty headed axe and a Stanley knife. These have never been brandished and never used. Being a taxi driver is difficult working long hours and occasionally subjected to abuse from passengers. The weapons came to the attention of the Police via another taxi driver who wanted him ‘off the Rank.’ The defendant mentions 4 lads as he has been threatened, previously. Mr Halliwell doesn’t think that the defendant realised the seriousness of the offence and he has now lost his Badge due to these proceedings. There are no aggravating features. The Bench following reading the report imposed 150 hours unpaid work and a 3 month Curfew 7pm – 7am. Costs of £85 to be paid. |

I take it he could only handle 3 lads at a time without a weapon. |

Well, there's 2 sides to this. One is all the taxi driver murdered threads on here. And the other is the assumption that everyone wanting a taxi is a nice person. I used to have a cosh, right up until I worked it out that had a hit the runner who I caught with it I could be facing a long time in jail for less than the price of a CD. So box clever, air freshner cans, hairspray all do an equal job to mustard gas without the chance of killing anyone. ![]() |

The guy obvioslly felt he need protection as he was unlikely to get much backup of his s***house mate who wanted him off the rank. |

I do not think anybody would have blown him up to the police.... if it hadn't been for the fact.... that he started threatening other drivers.... I think people came to the inclusion that he had lost the plot!!... and something needed to be done.... |

Of course, and my point was he got off lightly, not necessarily he got what he deserved. Many in the trade would sooner do five years for carrying an axe or gun, than be dead. And I struggle to criticise those with that view. |

weve had about 5 attacks in the past 2 months. one of the plod said carry a washing up bottle with half water and half viniger. realy stings in the eyes and you can clean your windows with it after |

It doesn't realy matter what you carry, if you use it as a weapon, even in self defence, you are putting yourself at risk of prosecution. |
