Cumbrian cab driver fined for having wrong licence

A Workington cab driver has been ordered to pay £140 for illegally driving a private hire vehicle.

Dennis Tinkler, 61, of Purser Road, Salterbeck, was stopped on a routine inspection while driving a licensed Peugeot Boxer private hire vehicle on Parkhill in Maryport on August 18.

Tinkler was interviewed under caution by an Allerdale council’s licensing enforcement officer where he admitted he was the holder of a hackney carriage licence, but not a private hire driver’s licence.

He said that he normally drove a licensed hackney carriage but the vehicle he had been allotted for the day was low on fuel so he decided to use the private hire vehicle.

By failing to hold the correct licence, Tinkler also breached the terms of insurance covering the private hire vehicle meaning he was not legally insured to drive it.

At West Allerdale Magistrates’ Court, Tinkler pleaded guilty to driving without a private hire driver’s licence and without insurance. He was fined £50 and ordered to pay £75 costs and a victim surcharge of £15.

The magistrates decided a driving ban would cause him exceptional hardship.

I wonder if this would apply to the 203020 drivers.These drivers have a taxi badge like me but there is a private hire badge as well.Drivers with private hire badges normally just do airport work. :shock:

That sentence tells me that he already had at least 6 points on his license, else exceptional hardship doesn't come into it.

Not enough IMO.

I can understand it in areas that don't have the same entry criteria for HC and PH, but in areas where they share the same criteria it's stupid if duel licenses aren't the norm.

Maybe down here we should have the same rule as up there i.e. a HC driver is automatically allowed to drive a PH.

In Dundee it is whether the vehicle you drive has a meter

Private Hire Car Driver's Licence - Application Form and Conditions
This is needed to drive a Private Hire Car. This only allows the holder to drive a Private Hire Car which is NOT fitted with a taximeter. Anyone wishing to drive a Private Hire Car which is fitted with a taximeter should apply for a Taxi Driver's Licence. Applicants also require to undergo an enhanced check through Disclosure Scotland. Please phone 434444 and we will send you the necessary form.

I do have an issue with the dual badge system in my area. To drive one of our stretched limousines the driver has to have the same badge as a taxi driver. The difference is that the limousine driver will very rarely be actually working within the borough and quite likely will be taking people to other towns and cities outside the borough. All jobs are booked in advance and at least 24 hours in advance. The driver still has to pass the local knowlege test.

Not quite fully duelled...We can Drive a PH on a Taxi licence but not a Taxi on a PH licence..but as there's no extra work or cost to getting a Taxi badge why would anyone here bother getting a PH only Badge.

Dual badge with topographical test etc.

I originally wanted to license my car as a hack but was asked not to by our LO's enforcement officer since it might aggravate the city (Lincoln) black cabs and at that time there weren't any ranks for us within about 10 miles.

Bear in mind I'm on perpetual night shifts though I've no idea how I ended up in this situation.

Pee's me off when I see the city hacks ranked up on pavements on Silver Street, blocking me from booked pickups and dropoffs and occasionally outside the city area plying ferociously.

Feeling pretty negative about the whole setup at the mo' :(

A city LO asked me recently to photograph any city HC or PH breaking the rules. I asked if they'd meet my medical bills and he said I was being neurotic. What world do thes idiots live in?

I would have thought those in favour of duel badging were more like licensing officers :?

seems a strange set up. here in thurrock if you have a ph badge then you can only drive ph vehicles. if you have hack badge you can drive either hack or ph vehicle thought that was the same all over the country
