HUNDREDS of drivers caught on speed cameras breaking a 40mph temporary limit could get off - because cops weren't told of the new signs in time. A Justice of the Peace yesterday ruled the restriction put up at roadworks on the A80 Glasgow to Stirling road could NOT be legally applied. The verdict came after a case against motorist Thomas McConnell was thrown out at Cumbernauld District Court. He was caught speeding by cameras on the road. But his lawyer Andrew Brown argued Transport Scotland - which is responsible for applying for the temporary limit - failed to inform police and the fire brigade about it on the day it came into force. And that made the speed limit "unenforceable". Last night solicitor Graham Walker, of www.roadtrafficlaw.com, said the result could affect hundreds of motorists charged with speeding on that stretch of the A80. He said: "We have challenged several other cases on the basis the legislation has not been implemented properly." Transport Scotland must notify police and fire authorities of temporary notices under the 1992 Road Traffic Regulations. But Strathclyde cops said they received notice of the order - which came into force on February 18 - five days late, while Strathclyde Fire and Rescue could not say when they were told. The Crown has been given leave to appeal. Last night the Crown Office and Transport Scotland were unavailable. http://www.thescottishsun.co.uk/scotsol ... eable.html |
