Taxi driver’s appeal refused

A TAXI driver who wanted to use a seven-year-old car for his business against council policy had his appeal refused. An application by Clifford Forrester, 43, to continue to use his seven-year-old eight-seater Ford Transit Tourneo as a taxi was refused by Cherwell District Council after new rules were imposed on the age of vehicles used for private hire.

Mr Forrester, of Langford Village, Bicester, took the matter to appeal and the case was heard at Banbury Magistrates’ court earlier this month. He claimed the council had acted outside its policies and the relevant legislation, but the case was thrown out.

Afterwards Nigel Morris, Cherwell’s executive member for community safety, street scene and rural services, said: “We have a responsibility to make sure vehicles used for carrying passengers are safe. “The new policy was introduced for just this reason but we have done all we can to lessen the impact of its introduction.

“Our staff did all they could to help Mr Forrester avoid this situation but he persisted and can now see that we have the weight of law behind us.”

The new rules were introduced on September 1, 2008, but the council postponed implementing them until September 30, 2009, due to the difficult economic climate.

Well if he goes to a de-restricted council and gets a HC licence for it he can go back to his council area and continue to work as a PH.

This kind of council policy encourages people to do this ..................

I wonder if this council uses minibuses on there own fleet for various things like school trips and social services, like ours does and they are around 10 years old.
we have a 7 year 11 month age limit, if you buy a car at 7 years 10 months you can get a 3 year licence on it

I hope this 7 year age limit catches on in other councils for the PH

There's a guy round here who's got a 9 year old vehicle and it looks like new, he looks after it like it's a new car. Everytime it goes in for test it passes.

Councils are under pressure to ensure the most fuel efficient fleet of vehicles under their control.

Therefore any argument against such a policy must be enviromental and not relative to the age or condition of the vehicle in the first instance and economic in the second.

the big larf is that +8 pass seats (D1 minibus) can be any age with a COIF and current test, i see smiley transits and Convoys that make me feel sorry for the passengers, but ive got an age rule?
