COLNE: Disabled man wins discrimination case at employment tribunal

A DISABLED Colne man is celebrating after winning a discrimination battle against his former employer.

Mr Steven Allen, of Burrell Avenue, brought Mr Asif Din of Ribble Valley Taxi Hire before an industrial tribunal over claims he had been unfairly treated at work and had not been paid.

Mr Allen, who suffers from mobility problems, had found work through Shaw Trust, which helps disabled people get back into employment.

He said: “I was told by the firm I would be doing the school run, picking children up, which would not require much lifting. But I was put on the airport shift, picking up heavy suitcases and loading them into the cab.

“I couldn’t manage it and before long ended up in hospital. On top of this I was also not being paid.”

The employment tribunal, in Manchester, found Mr Din had subjected Mr Allen to unlawful disability discrimination, by failing to pay his wages.

He was ordered to pay Mr Allen his outstanding wages of £345 and a further £1,526 for injury to his feelings.

Cases like this Set back the Disability cause rather than enhance it...what employer is going to take a chance on hiring someone if there is the least bit chance that the employee might end up biting the hand that pays them....

Im sure this guys Grievance is Genuine...But Some Cynics might think that this was a way to earn money..."Claim windfalls" could be a nice little earner..

I don't see what disability has to do with not paying his wages. However, it would be interesting to see on what grounds the employer withheld the wages. There isn't any comment made relating to the actual job description and whether or not the tribunal agreed it was unfair to charge the job description and consquently the job for this chap

being cynical id guess the job was subsidised by the DSS and his wages were 70% paid for anyway
