Dear Driver,

OVER RANKING AT FOX STREET - FOREST STREET RANK SUTTON IN ASHFIELD

I am writing to you regarding the dangerous situation of Hackney Carriages over-ranking along Forest Street whilst waiting to go on to the Taxi Stand. The Situation is that over-ranking along Forest Street is still continuing at certain times of the day, drivers are therefore continuing to fail to comply with conditions attached to their Hire Vehicle Drivers Licence.

I must inform you that the situation will continue to be monitored over the next 3 months by visits to the rank and the use of overt public CCTV, and advise you thatno further verbal or written warnings will be issued. Drivers now found to be over-ranking will have their Hire Vehicle Drivers licence suspended under section 61(1)(b) of the local Government (Miscellaneous Provisions) Act 1976 for a period of one month.

Ashfield District Council would consider a suspension on these grounds to be in the intrests of Public Safety. As a result, in accordance with section 61(2)(b) of the local Government (Miscellaneous Provisions) Act 1976 the suspension will have an immediate effect. Drivers who contiue to fail to comply with conditions attached to their Hire Vehicle Drivers licence, leave themselves at risk of their licence being revoked.

I must further inform you that if the situation continues, steps may be taken to close the Taxi Rank on Fox Street on the grounds of pubic safety.

Notwithstanding anything in the Act of 1847 or in this Part of this Act, a district council may suspend or revoke or (on application therefor under section 46 of the Act of 1847 or section 51 of this Act, as the case may be) refuse to renew the licence of a driver of a hackney carriage or a private hire vehicle on any of the following grounds:—.

(b)any other reasonable cause.

(2B)If it appears that the interests of public safety require the suspension or revocation of the licence to have immediate effect, and the notice given to the driver under subsection (2)(a) of this section includes a statement that that is so and an explanation why, the suspension or revocation takes effect when the notice is given to the driver.]

It's these kind of threats I hate. It's like saying, although we haven't provided you with sufficient facilities for you to provide the service that we require we will take away from you those scant provisions if you don't do as you're told

And their reply will be, after contacting the National Taxi Association and working within their regulations there are enough spaces within the district.

The National Taxi Association have no regulations regarding rank space.

I know I've been dragged round the town kicking and screaming shopping with her indoors. Add that to fact that I didn't finish until 6:30am this morning my cannister wasn't working right when I posted it. :oops: :oops: :oops:
