Grandad, GBC or anyone else for that matter.

Let's say I walked passed you on the rank and you are reading a magazine. I then accuse you of having kiddie porn stuffed between the pages. The rank is covered by CCTV, and all this is caught on camera except for what you were looking at. A punter jumps in your taxi, and you drive off.

As a consequence of my allegation you are brought before the council committee to decide if you are fit to drive a taxi.

Fact, you are on the rank sitting in your vehicle. CCTV footage establishes you were there at the time and place.

Fact, you were looking at a magazine. We can see that from the CCTV footage also.

Fact, I walked passed and looked in your window and saw what you were looking at in the magazine. This too is captured on CCTV.

I've now established three facts, but you deny this serious allegation. You can't prove your innocence but I, nor the council can prove your guilt. The police can't find the kiddie porn anywhere.

In the interests of child safety should the council remove your licence, and how do they decide?

What credible evidence should they base their decision on?

That's assuming the burden of proof to prove your guilt is theirs and not yours to prove your innocence.

Oh and remember, there were no facts established in my case just a simple allegation.

Okay CC, I've walked passed you on the rank and made the accusation, and you are now in the frame up at Council HQ, but you have an added problem. You look like a kiddie fiddler in real life.

Bloody hell Skull...have you been watching Matthew McConaughey's summing up as "Jake Brigance" in the film "A time to Kill" with Samuel L Jackson...because your summing up above, with attempted 'curve ball', was spookily similar.

Taking your analogy a little further, relating to your question,
"What credible evidence should they base their decision on?" (as to whether to remove the driver's licence)...there would clearly be enough reason for a LA or Police to investigate any allegations and if no evidence was found, you would hope and pray that the truth would win the day.

I note that in your cleverly constructed version above however, you say "The police can't find the kiddie porn anywhere"...illustrating a level of compliance, which is somewhat different to your case.

What would definitely be a big mistake, would be for the said driver to "throw his toys out of the pram" and refuse to even answer any questions or co-operate with officials.

Your argument should have been to correct mistakes within a system that might yield an unfair outcome...not to "throw the baby out with the bath water", so to speak. Another intention, perhaps, might be to ensure that if anyone is proven to be lying or spiteful in any (false) claim made, that serious punishments would be given to them, which would act as a deterrent to lies.

Instead, it might be argued that, to use another driving analogy, even if you're completely innocent, you've acted like someone who refuses a roadside breath test because you don't like the attitude of the officer. You might not have had a drink, but not providing a sample would also carry a ban.

Maybe, on reflection, you could have fought this a better way Garry...but then again, I neither expect you to agree, or admit this.

Wait until they get their hands on his computer.

But seriously skull, I hope this dark humour ends here and doesn't go further. There didn't seem any lower point than the persistent rape jibes...but to continue would surpass it.

Forget about me and deal solely with the scenario I have created. You find yourself in the frame with the allegation made against you.

Speaking of "curve balls" . ..

They can find you... guilty or not guilty.... but without the evidence of the pictures... then the case can also be found..... not proven..... but without attending.... you leave the court or council no option but to find you guilty..... you're obviously enjoying whatever it is you're doing..... I hope it turns out on the good side for you....

I'm accused of anything I'm stepping up and arguing my case

If some one made an allegation to you in a pub infront of a public audience would you not want to defend yourself

Or would you do what you usually do and start swing insults then fists?

"the court or the council but to find you guilty" for what?

Now you are in the frame Mr. T. This is not about me and how I would deal with the situation. This is about you. :-|

Unfortunately it's not about me... the moment an accusation was made I would have been breaking down their doors... expecting a full written explanation of all allegations... which would have been immediately placed on file with my solicitor.... But then that is just me.
