Drunk driver who crashed into taxi cab was going '85mph while having sex in the back seat' Last updated at 10:55 PM on 17th June 2011 Quite how someone manages to drive while having sex on the back seat of a car is anyone's guess. But that's what a cabbie claims he saw a drunk driver doing moments before the man smashed into his taxi on the Capital Beltway, near Huntington, Virginia. The 21-year-old driver of the car was convicted of drunk driving last year, court records show, but the cabbie, who has not been named, has since filed a $75,000 lawsuit against the man. The lawsuit claims the driver had been 'doing 85 miles per hour' and had been 'having sex with a female' at the time of the collision. It also claims the defendant was 'partially or totally' in the backseat of the car' at the time of the accident. Court records show the man from nearby Woodbridge had been coming back from his 21st birthday party in Baltimore when the crash happened. He now denies driving the car at all, as does another friend who was also in the car at the time, according to the Washington Post. The driver's female companion has been dismissed from the case altogether. The young driver's lawyer Frank Prior, has rubbished claims his client was having sex while on the road saying there are 'no facts on it.' The cabbie's lawyer Douglas R Stevens had sought punitive damages against the defendant and the friend. He said 'having sex at 85 miles per hour while drunk on a freeway is wilful and wanton negligence,' at an earlier hearing. A Fairfax judge threw out the punitive damages claim however. sounds a bit far fetched to me if he was partially in the back seat his foot would NOT be on the accelerator |
