Taxi driver sexually assaulted passenger after she refused sex with him

A taxi driver sexually assaulted a teenager after she refused to have sex with him as payment for the fare.

Christopher Doyle, 44, had told the girl he gave "freebies" in return for sexual favours shortly before carrying out the terrifying attack on her.

He told the 17-year-old he had been paid with sexual favours previously after she told him she was "skint" as he drove her home from a nightclub.

He then put his hand on her thigh and genitals and when the girl fled from his cab, he followed her out and pressed himself up against her as she was trapped against his vehicle.

Doyle, of Wiston Place, Dundee, admitted carrying out the indecent assault on the girl in Longforgan, near Dundee, on October 10, 2010.

He was placed on probation and the sex offenders register for three years, banned from having any unsupervised contact with anyone under 17 and banned from taking any voluntary or paid work without having the job approved by his social worker.

Perth Sheriff Court heard how Doyle struck after the girl was left on her own with him and he drove her up a quiet lane and switched off the vehicle's lights.

Fiscal depute Carol Whyte said the girl had been at Fat Sam's nightclub in Dundee when she and her friend were picked up by Doyle.

She said: "The complainer's friend was dropped off by the accused. Before the taxi left her friend's house the complainer moved into the front seat as she did not want to sit in the back because of the child locks. She was then driven to Longforgan at her request. She told the accused she was 'really skint' and asked to be dropped off at the bus stop. The accused asked her if she lived far away."

Ms Whyte added: "He said he had given freebies before and asked her if she knew how he had done that. The girl realised he was talking about sex and said she would pay her fare."

Doyle then told the girl he would cut the fare to "ten pounds and a snog." He then drove on and pulled into a quiet lane where he told the teenager 'no-one can see us'."

Miss Whyte said: "When she arrived home her parents saw she was in a hysterical state and the police were contacted. Swabs of DNA taken from the girl's body matched the DNA of Doyle."

Doyle was also told he could only be in the supervised company of children with the approval of social workers and placed on probation for three years.

I mean three years probation, for sexually assaulting,terrorising a wee lassie. Tell me i missed something here.
Well i hope that wee lassies got a psycho dad and a couple of likewise uncles built like brick outhouses. :idea:

I don't get the ban on contact with children. What am I missing here?

Was the victim 17 then or now?

And why has it taken until now to get into court, particularly as the perp appears to have admitted the crime?

I take it is a saloon car. Surely time for all cabs to be WAVs? Or was this taxi really a private hire?

And child locks? Really?

And she managed to get out of the car, yet the driver pinned her against it? How did he manage that? How did she not manage to leg it before he even made contact?

And the struggle? How did she struggle? How did the DNA transfer? And could there have been another explanation for that?

OK. So the guy appears to be a scumbag. And deserves his punishment, and more.

But there is enough about this case to raise real issues in my mind.

He's busy at the moment he's got a new room mate, he's trying out a new range of KY Gel, it's got added sand because he likes it hardcore.

Unpalatable though it may seem, in a one to one situation this guy's case should never have come to court, and a conviction should never have been achieved. I wonder if this is why only probation was handed down.

The upshot it seems to be a fairly minor incident despite how it was wrapped up by the PF. One to one, no corroboration and any number of excuses for how any DNA was spread. The young girl was clearly behaving in a way inappropriate for her age, there was no real need to join the driver in the front of the car and alcohol was assuredly involved. Had I been on a jury I'm not sure I would have found him guilty.

This case is a mystery to me. I can't believe the circumstances as related.

Notwithstanding the circumstances of this case, and bearing in mind when charged with any offence, the clear advice has to be to say nothing without the attendance of a brief. And then say only that which you are required to by Law. That is name rank and serial number. You open your mouth and you're digging a hole for yourself.

Now, was this a taxi or a private hire?

I think what we've got here, is a 44-year-old taxi driving sex pest who should have known better than to prey on a 17-year-old slapper, sending out all the wrong signals. Ultimately, this guy's sexual deviance was his undoing. He obviously doesn't know where the line is drawn. Personally, I think the court got it right. However, the way they went about getting a conviction does seem a little suspect under the circumstance. :?
