Taxi driver accused of exposing himself to passenger
A TAXI driver allegedly exposed himself to a young woman and suggested they have sex together when she hired his cab to get home, York Crown Court heard.
Opening the prosecution against Alexander Naismith, Aisha Wadoodi claimed he told the passenger: "All she would have to do is lie down, go on, ten minutes, it won't be long." She was alone with him in the taxi after they had dropped her friend off earlier on the way home. Police found Viagra in Naismith's taxi, next to the driver's seat, she claimed.
The jury have seen details of Naismith's Baboo profile, which the prosecution allege supports the woman's account of what happened in the taxi on July 25, 2015. Baboo is a dating and social media website.
Naismith, 57, of Burtonstone Lane, Clifton, denies indecent exposure. He alleged to police that he had never exposed himself to the woman or offered to have sex with her and that she was very drunk at the time. He claimed he used the Viagra for marital sex. The prosecution allege CCTV taken of the woman leaving a nightclub shows that she was not drunk.
Defence witness and taxi driver Brian Scrivener, alleged he had accidentally set up the Baboo profile in Naismith's name when both worked for four years together at a taxi firm that has ceased trading. He alleged that when he used the office computer, he had logged via Facebook into Baboo, thinking he was logging in as himself. But Naismith had left his Facebook open on the computer and Baboo had transferred photos and other details from Naismith's account onto Baboo.
The Honorary Recorder of York, Judge Paul Batty QC adjourned the trial until Monday to give the prosecution time to investigate Mr Scrivener's claim, telling the jury they had not been aware of his evidence before the trial.
