Magistrates told Joel Aggrey the offence was made worse because he was 'so, so drunk'

A drunk man launched a flying kick at a taxi outside a nightclub after becoming angry.

KFC worker Joel Aggrey was at the Arkade nightclub in Leicester city centre when he attacked a taxi picking up a fare.

The 22-year-old smashed the taxi’s window with the kick and then punched the car before walking off up Church Gate.

He appeared at Leicester Magistrates’ Court on Tuesday where he pleaded guilty to one count of causing criminal damage.

Prosecutor Sally Bedford told the court: “The taxi driver was outside the Arkade nightclub in Gravel Street, Leicester, picking up a fare just before 6am on February 17.

“He had his fare in the back of the vehicle and he looked towards the club and saw the defendant run up to the taxi and do a jump kick, smashing the window.

“The defendant followed up by punching the door several times.

“The passenger was very upset and shaken.”

What happened after the attack?

She said Aggrey walked off along Church Gate and the taxi driver called 999.

The police and the city centre’s CCTV control room then worked together to locate Aggrey and he was arrested later that morning.

Miss Bedford said: “He was arrested and said he had no recollection of the incident but something had made him angry.

“He accepted he was responsible for damaging the taxi.”

She said that rather than charge Aggrey, Leicestershire Police initially offered to let him off with a caution if he agreed to pay £650 in compensation to the taxi driver.

But he failed to pay the money and was charged with causing criminal damage.

Aggrey, of Wellinger Way, Braunstone , Leicester, who was not represented in court, told the magistrates: “I can’t recall too much. I was just angry and something happened.”

Aggrey was given a 12-month community order and ordered to pay the £650 compensation in full to the taxi driver.

What did magistrates say?

The chairman of the magistrates bench, Roger Wood, said: “Admittedly you do not remember much about this but that’s an aggravating factor because you were so, so drunk.

“Imagine how it would feel for the taxi driver if someone he didn’t know landed a flying kick at his taxi and smashes it and punches the door.

“We give you credit for your guilty plea. Otherwise we might be considering a more stringent community order or custody for this.”

At least driver was adequately compensated

Compensation is the priority.

It takes precedence over costs, fines or victim surcharge.
