This is in numerous news outlets, like the BBC, ITV News, Bradford Telegraph & Argus, and Yorkshire Live.

All use the phrase 'causing death by driving while uninsured', but miss out the other d-word, although oddly enough it's in the Mail Online's headline here.

But the actual report below misses out the d-word (as highlighted) which suggests all the reports came from a single source, like the Press Association news agency.

But it's a bit odd that there's slightly more detail in the headline here than in the actual article.

A man has been charged after running over and killing a seven-year-old boy in Bradford.

Malakye Hall died when he was hit by a taxi in Manchester Road, Bradford, on August 11, 2020.

Mohsin Hussain, 31, of Carlisle Terrace, has now been charged with causing death by driving while uninsured.

He has been bailed to appear at Bradford Magistrates Court on September 9.

Malakye was crossing Manchester Road, at the junction with St Stephen's Road, by himself when he was struck by a black Toyota Auris Estate taxi at around 10pm on the tragic night.

Malakye's mother Wendy Hall, 33, was jailed after leaving him in their house alone, which had no electricity or gas, while she went to see her partner.

Hall had left her mobile phone with Malakye for him to play on while she was away, but it appeared that he got out of the house shortly after she left.

Police who arrived at the crash scene found the boy had the damaged phone on him - and detectives went to the house which was in darkness with the door open.

Hall pleaded guilty to neglect and was jailed for three years.

Witnesses tried to save his life by giving him CPR until paramedics arrived but he died a short time later in Bradford Royal Infirmary.

Malakye Hall was a 'happy and funny' child with a 'bright smile'.

One of his teachers described him as a 'pleasure to teach' and said at the time he will be 'sorely missed'.

Sharon Clunis-Begley wrote: 'Our 7-year-old baby Malakye was tragically taken from us on Tuesday 11th August.

'We are asking if anyone can help with costs towards giving our beautiful boy the funeral he deserves.

'This is a very upsetting and distressing time for us.

'Malakye was taken from us far to soon.

'Any help will be so gratefully accepted. Sleep tight our little man.'

I'm sure Sussex will know, but looking at the Sentencing Council guidelines here, it may be he's been charged with two separate offences - causing death by dangerous driving, and causing death while driving uninisured. But the various articles only really report the causing death while driving uninsured charge, and only the Mail's headline above picks up the dangerous driving charge :?

It may actually be that the various reports are based on this formal 'charge note' on the West Yorkshire Police website:

So it may be that there's no actual dangerous driving charge at all, and just the causing death by driving while uninisured charge.

Just noticed too that there's no mention of the t-word above, nor in the various reports, except the Mail Online. So only the Mail's report above picks up on the dangerous driving angle, and the t-word.

Reports at the time said it was a PHV involved, but who knows? On the basis of the police notice, could have been anyone driving ](*,)

The charge is causing death by dangerous driving, I suspect he has also been charged with driving with no insurance.

But the no insurance is an aggravating factor for the dangerous driving charge, which can up the sentence by a year or two.

Whilst no insurance is usually fine and points.

A taxi driver who hit and killed a seven-year-boy in a horror crash after the youngster wandered into the road has been jailed.

Mohsin Hussain, 32, who admitted causing Malakye Hall’s death while driving at almost twice the speed limit.

He was sentenced to nine years and nine months in jail yesterday.

Bradford Crown Court heard the dad-of-three’s taxi license had expired a month before the crash, but he’d continued to operate and took roughly 70 further fares.

Just before the collision on August 11, 2020, in Bradford, West Yorkshire, dashcam footage from Hussain’s black Toyota Auris showed him speeding several times in the city.

The shocking video showed him going around a roundabout the wrong way, running red lights and undertaking other motorists.

The court heard Malakye had got out of his home while his mum, Wendy Hall, 33 – who was jailed last month for three years for neglect – was visiting a partner.

And at 10pm, Hussain struck Malakye on Manchester Road at the junction with St Stephens Road, where he suffered fatal head injuries and died in hospital.

Police later found Hussain was travelling 53mph or 54mph when he hit the lad in a 30mph zone and had more than double the limit for cannabis in his system.

At the sentencing yesterday, Malakye’s sisters gave a heartbreaking victim impact statement to the court, saying Hussain had ‘robbed’ the boy of his future.

She said: ‘Malakye was the cheeky playmate as our youngest sibling, he was loved and liked by all those who knew him well.

‘We will miss watching him turn into the man he would have become. We have been robbed of our childhood with him but also robbed of a future life as adult siblings with Malakye.

‘The actions that led to the death of our brother Malakye have affected our lives immensely. His death was a smack in the face, a real shock to us all.

‘It has completely changed our lives in terms of where we live, our schooling, the loss of neighbours and friends we grew up with and our overall confidence in trusting people or environments we find ourselves in.

‘The sentence of losing Malakye will never end, it is a life sentence for us. We will have to live the rest of our lives without Malakye, our brother who was tragically taken from us far too soon.’

During the hearing yesterday, prosecutor Abigail Langford conceded that Malakye appeared to have run into the carriageway before the fatal incident.

But she said the judge had to take account of Hussain’s dangerous driving over the previous 2.6 miles before the collision.

The court heard that Hussain was dealt with for a speeding offence just six months before the collision

However, he had remained at the scene of the incident and had subsequently expressed genuine remorse.

His barrister Oliver Jarvis said Hussain had paid some money towards Malakye’s funeral and had said he was sorry during an interview for a pre-sentence report.

Sentencing Hussain, Judge Jonathan Rose said he had been driving at speed and without regard for other road users, including pedestrians, before he killed the little boy.

He said: ‘You were prepared to drive on public roads when you knew, or ought to have known, that your ability to drive was significantly impaired.’

Hussain was banned from driving for a total of ten years and ten months and he must also take an extended re-test at the end of that disqualification period.

I'm guessing speeding might be subsumed into dangerous driving, but would drug driving not remain as separate charge?

can you be charged with causing death while uninsured ?

I would have thought charges would be death by dangerous driving and then driving without valid insurance and also a speeding charge although the latter probably can't be prosecuted without the evidence from a speed gun or camera.

Yes.

However I suspect the police were concentrating on the more serious charges that led to his 9 year prison sentence.

It also looks like the charges came a long time after the incident, probably down to the first lockdown, so maybe the drug driving charge missed the summary offence 6 month time limit.

All the articles in the thread are a bit vague about the precise charges, but this is the official West Yorkshire Police news release about the sentencing. So it looks like he admitted causing death by dangerous driving, and presumably there were no specific charges relating to the speeding, drugs or insurance offences.

No doubt Sussex will know a bit more about it all, but as he seems to allude above, maybe there was no real point in the other charges if he was going to admit to causing death by dangerous driving. Or they were time barred. Or something like that.

Mohsin Hussain, 32 of Carlisle Terrace admitted at Bradford Crown Court in October 2023 to causing the death by dangerous driving.

Today (Thursday 23 November) Hussain was sentenced to 9 years and 9 months in jail, He was disqualified from driving for 10 years and 10 months and there was a deprivation order for the vehicle used.
