A TAXI driver from Yorkshire who caused the death of a promising student who was due to embark on her university career has been sent to prison for two years.


Shahid Rashid was in a head-on collision with a motorcycle that killed pillion passenger Lian Senior, 20, from Wakefield, who was two months away from starting a course at Liverpool University.

She did not live to find out that she had passed her A-level exams.

At Leeds Crown Court yesterday, Rashid, of Dorset Close, Bradford, was jailed for causing the accident.

Miss Senior's college friend who was driving the bike, Lee Horner, 21, broke a bone in his back, broke his wrist, suffered serious damage to his internal organs and a collapsed lung. His wrist and back still cause him discomfort and medics say the pain could worsen as he gets older.

Miss Senior, of Humley Road, Kettlethorpe, near Wakefield, went for a ride on the bike after her shift at the Dam Inn pub at Newmillerdam in Wakefield on July 1 last year.

Rashid, 32, pulled out from behind a Nissan Micra which was waiting at a stop sign in front of temporary traffic lights at roadworks on the A639 Leeds Road at Castleford. The private hire driver, who had no previous convictions, said he thought the Micra was parked, so he overtook it with the intention of turning left.

He told police he only saw the bike when it was in front of him, adding: "It felt like it dropped down from the sky."

Micra driver David Baxter, 42, told an earlier hearing: "The car appeared to come towards me and slow down, but then it pulled out from behind me onto the other side of the road. I got the impression the car was going to go through the red light."

Rashid, who was working for Tiger Cars in Castleford at the time, was found guilty by a jury at an earlier hearing of causing death by dangerous driving. He claimed that his driving was careless but not dangerous in the legal sense.

Mr Horner and friends and relations of Miss Senior were in court yesterday to see Rashid sentenced. Mr Horner said the jail sentence should have been longer and this was echoed by Miss Senior's aunt, Diane Callaghan who said: "It's not enough, but it never would be enough."

She said Miss Senior's parents Alan and Ann were too upset to attend court.

The Recorder of Leeds, Judge Norman Jones QC, told Rashid: "I suspect you were anticipating going home when you took a chance.

"As a result of your impatience a young lady who had the whole of her life ahead of her and was anticipating going to university, and had worked hard for it, was cast into oblivion."

He added: "No comments of mine or yours can in any way assuage the grief of that young lady's parents. I have read the statements they have written and it's clear their lives have been very seriously damaged."

Judge Jones said it not the court's job to "wreak vengeance" but to decide the "degree of wrongdoing".

Yunus Valli, mitigating for Rashid, said his client was genuinely sorry for what had happened and had two children of his own, aged three and four months. In a letter to the court, Rashid said: "Being a father myself my heart goes out to them (her parents) and I hope that they can forgive me. I too will have to live with the consequences of my mistake for the rest of my life."

Rashid was also disqualified from driving for four years and must pass an extended test before he c an drive again.

Life time in prison may deter people from driving like this whether they are taxi drivers or not !!!!!!

A tragic loss which could have been avoided if the driver had considered his actions before he attempted the illegal manouvre.
