Allan Duffy made countless decisions about applications during his five years of service in the chambers from 2012 to 2017.
And the former Inverness West councillor was horrified this week to learn of the decision not to revoke the operator’s licence of David Brown.
The taxi driver was jailed for over six years in May after being found guilty of raping an 18-year-old passenger in the back of his cab in December 2023.
Last week Highland Council’s licensing committee allowed him to keep his operator’s licence, which is required to ensure booking, vehicles and drivers meet necessary safety standards.
It is a decision that has caused uproar in HQ with the local authority’s most senior legal officers already filing paperwork to have it reviewed by all councillors.
The divisive vote was split exclusively on gender lines with the six men on the committee allowing him to keep his licence, despite objections from top council officials and the police, while the four women voted to have it removed.
The decision has also been condemned by charity Rape and Sexual Abuse Service Highland, who have described it as “deeply troubling”.
Brown’s taxi driver’s licence, which is required to actually drive a vehicle, had earlier been suspended in January 2024.
A petition opposing the decision to let him keep any licence has now been signed by more than 2,500 people.
Speaking to The Press and Journal, Mr Duffy, who is one of those who started the petition, explained the decision he would have taken if he was still on the committee and why.

It is understood members were told the paperwork was needed to ensure his wife could continue to earn an income.
While the pleas helped persuade the six men on the committee to not suspend the licence despite an objection from the police, the four women still called for it to be revoked.
Highland Council has since clarified it is not possible to transfer an operator’s licence from one person to another.
Mr Duffy, who was an SNP councillor before being expelled from the party, is clear about what decision he would have taken.
He said: “This is completely wrong. This licence should never have been allowed to continue.
“If I had been on the licensing committee, I would have put forward an amendment that we suspend the licence until such time as his wife applied for one in her own name.
“For me, that would have been a much more sensible decision to make.
“I don’t know how much time he has left in jail, but the way it has been left now is that he can go back to that business when he gets out and carry on running it.
“I don’t know the specifics of his business, but these licences can cover booking offices where people go to book taxis.

“If his wife wants to carry on running the business then she can obviously do that as much as she wants.
“For me, the licences would have to be in her name though. I would never have supported anything remaining in his name.
“As a father, I wouldn’t allow my kids to use that company. There are other good taxi companies in Inverness, I would tell them to completely avoid one being run by a rapist.”
Petition wants licensing committee members suspendedIn the hours after The Press and Journal story was published, Mr Duffy as well as A9 dualling campaigner Laura Hansler and Inverness campaigner Diane Wilkinson launched a petition calling for Highland Council to immediately revoke Brown’s operator’s licence.
It also calls for any committee members found not to be doing their duties correctly to be removed pending an investigation.
The online petition has already been signed by more than 2,500 people less than 48 hours after it was published.
Ms Hansler told The P&J she “blew a gasket” when she learned of the licensing committee’s decision.
She said: “I couldn’t wrap my head around any part of it, no part of this makes sense.

She added: “It’s horrific. The poor lassie who got in this taxi would have thought she was getting in a taxi being driven by a good Invernessian – but it was actually being driven by a predator.
“Tourists and locals get in taxis all the time. They need to be able to feel safe when they get in vehicles.
“This is also going to damage the reputation of decent people who run good taxi companies in Inverness and the Highlands.”
Inverness campaigner Diane Wilkinson, who also started the petition, told The Press and Journal she thinks the decision “smacks of misogyny”.
She said: “To me, it just shows that these people don’t care about the safety of women, girls and other vulnerable people.
“As a woman, and as a mother who has a daughter, you put your trust in a taxi driver when you get in their car.
“In my opinion they’ve made their position on this committee untenable. Because when they’ve made decisions like this, how can they be trusted to make any other decisions in the interest of public safety?”
Rapist taxi driver timeline: What happens next?Brown was jailed for six years and nine months in May after being found guilty following a trial where he maintained his innocence throughout.
He had admitted having a sexual encounter with the 18-year-old female passenger in
December 2023, but had said it was consensual.
Highland Council’s licensing committee suspended his driving licence in
January 2024 after the offences came to light.
They then reviewed his operator’s licence on
June 23 this year after he was found guilty in May.
During the talks a majority of councillors took the controversial decision to allow his licence to continue following a vote.
However, Highland Council’s top legal officers then took the rare step to file paperwork to have that decision reviewed by all 74 councillors at a full council meeting.
It means all elected members who are not on the licensing committee will have to receive specialist legal training just so they can make a decision.
It has not been confirmed when those talks will take place.
However, Highland Council entered its summer recess this week with
normal business not due to resume until August.
