Thanks to kit Carson I located the article he referred to in another thread.

Luton Cabbie jailed for perverting the course of justice, in respect of speeding offence. The video link is at the top right of the page.

As opposed to the right to speed?

I got caught a couple of years ago by a forward camera in Derby. I tried to claim that I was being discriminated against because a forward facing camera can't catch a motorcycle, they have no front number plate. I didn't take it to court but do you think I would have had a case?

I'm not sure what you mean by this. Of course there is no right to speed.

But it happens. And all I'm concerned with is that rules are fair and applied properly.

I can't really see the difference as regards "rights", indeed if it aids ID then to that extent it would perhaps protect against wrongful conviction.

I think the photos from the rear was basically a technological thing. I also seem to recall that the standard gatsos couldn't face the car because the flash would blind the driver.

Of course, technology has moved on now.

To save the cops a shed load of time trying to ID the driver from the photo, and to save them replacing all the speed cameras with ones that take the pics from the front. Essentially, making us do their job for them.

A photo from the rear of the car tells us nothing other than that the car was speeding, but of course it's the driver that's prosecuted.

Thus without the ID of the driver being divulged obviously no offence could be prosecuted.

But obviously this process in itself gave rise to the arguments about an offender's right no to incriminate themselves.
