A while back JD asked for a copy of the above hearing. Eventually I've dug it out for all to see and read. http://www.bailii.org/ew/cases/EWCA/Civ/2002/1526.html |

LORD JUSTICE KEENE - from the above post "The local authority would have to be satisfied that the demand was, first, and foremost, for a taxi, so that inconvenience was being caused to the public through the shortage of taxis. It is in the end all a question of evidence." and what have I been saying. |

Eh? Wasn't that the case where, after the passage you quote, the judge agreed that evidence of hirings by PH was evidence of unmet demand for taxis. I think that's what we've been saying Charlie, not you. |

Quote: At the other ranks 85 per cent of departures were by private hire vehicles
sounds like a serious enforcement problem

In all fairness to them the issue of latent demand was/is a bit of a dogs dinner, and the only presendents seemed to go in their favour.
As for the zoning issue, again the judge went against the usual way of assessing this issue, but I'm pleased he did, cos many councils already discriminate against PH drivers, so adding HC drivers to the list is a step too far. According to the judge.
