In May 2005 Thanet decided to lift numbers control but the local Taxi trade is challenging the democratic decision of the council. The unusual step being taken by the local Taxi trade is that they have started the proceedings through the Magistrates court. They have recently found out that the Magistrates court is not the right place to challenge the decision of the council and it is assumed at some stage they will apply by way of judicial review to have the decision of the council overturned.

Those of you who are familiar with current existing case law will already know that the Thanet Taxi trade might just as well throw their 15 grand down a drain.

Here are the minutes of the Thanet decision.

REQUEST BY THE DEPARTMENT OF TRANSPORT TO REVIEW QUALITY CONTROL PRACTICES (*)
The Board further considered the options available in the light of the correspondence received from the Department of Transport and the request made by the Licensing Board.

The Licensing Manager distributed an amended copy of Annex 1 as an entry concerning 5.10.04 had been deleted in error from the original document.

Officers also circulated two letters from The Margate Taxi Owners Association for Members information.

A representative for Ramsgate/Rural and Margate drivers, was present and addressed the Board.

A notice of motion was signed by more than 50% of the membership which enabled the following recommendation to be put.

Moved by Councillor Savage and seconded by Councillor A Poole that:

“(A) to deregulate and grant hackney carriage plates to anyone meeting the application criteria;

(B) to de-zone, making Thanet one hackney carriage zone; and

(C) to request that the Officers prepare a report for the next meeting to enable Members to discuss the standards of Hackney Carriage and Private Hire vehicles and drivers”.

MOTION ADOPTED.

Here's your starter for ten. If you hypotheticaly put yourself in the shoes of Thanet Taxi trade, on what point of law would you take Thanet council to court and expect to win?

I wonder if we can get a member of the Thanet Taxi trade to debate their reasoning, in first trying to get relief through the Magistrates court and second, taking the huge gamble of investing 15 to 20 grand on a judicial review of a council decision that is doomed to fail.

If they listen to the likes of the Plank and the Goon, then it's going to cost them tens of thousands.

If they read the law, it will cost them nothing.

However methinks the likes of the Plank and the Goon will convince the Thanet trade that they know best. [-(
