I dont doubt what you say, and I'm quite sure in sunny sussex that I could drive my PH car for one PH company one day and refuse a couple of jobs and not get binned......and I'm quite sure on the next day they'd let me drive for another operator, and the say after that another.

But in most cases the PH driver would get his equipment removed if he did such a thing.

If the choice confronting the operator was a) put up with a driver refusing a job or two, or b) giving the driver a contract of employment, how many ops will go for b?

Why not.....if a PH driver hires a radio he doesnt set his own fare.....its the PH operator.

And the PH driver works under the instruction of the operator.

Admittedly, historically HC drivers arent good at the above, because in most cases they think the better hires are from ranks, and in some cases they switch radios off?

Else every sub-contractor in the country would have to be employed by the contractor.

these rules only apply to bus Operators usually doing some of their work in mainland europe...the UK rules are more flexible and affect fewer people.

or permanently adapted to carry more than nine people including the driver, used for the carriage
of passengers within the UK or between the UK and other EU and EEA countries and Switzerland.
Vehicle operations that take place off the public road or vehicles that are never used to carry
passengers on a public road are out of scope.

even Minibus drivers in the UK come under the Domestic rules which do not as yet regulate Drivers hours.

None of these Mobile rules as far as I know affect or ever will affact Hacks or PH drivers using Vehicles with Eight or less passenger seats....Dont panic Mr Mainwaring..
