Well i went for the dont mention it approach, they took my licence to photocopy, i entered all the convictions on the application form and the nice lady took £95 off me and came back with my shiny new badge. also had to sign a DVLA mandate so that they will send the LA a copy of my licence to check that the licence i took over is up to date. So lets see what happens next. I checked with DVLA and points stay on your licence for 4 years and 3 of mine are due to come off in 4 days time.
Great! well worth just putting the forms in and keeping quiet. You will find as you deal more with you local LA that as long as you tell the truth about any convictions you have, the powers that be will tell you if you have a problem or not. Good luck!

Hmmm Went to the Council today to re-plate a vehicle, as i was walking out the door the nice lady says " oh we noticed that there a few things on your license that were not on it last time , i have had to send it up to the head licencing officer to look at, i expect he will be contacting you". Its taken them a few weeks to notice even though i was totally truthful on the form. Here we go .....

If they have issued you with a license, then when that licensed was issue they have deemed you 'fit and proper', whether they like it or not. Of course it is accepted that you told the truth on your form.

So the head honcho can look at the form for as long as he likes, but there is f*** all they can do now.

They can only take your license away if you are deemed not to be 'fit and proper', and that can now only happen next time you relicense, provided you don't receive any more convictions or proven complaints from now until then.

Don't usually quote my own posts but I must this once.

Today a judgement came out, and it's taken me ages to read it, but it appears the council can, if they are following their own procedures nullify a license once they have issued it.

http://www.bailii.org/ew/cases/EWHC/Adm ... /2845.html

Now this did deal with a new applicant, and I'm not convinced he was represented properly, but I think it's something you should read in full.

And then ask any questions. :?
