So basically what your saying is that any private hire vehicle can park up anywhere they like and when approached by a member of the public as long as you ask them have they booked a car and they say no, you will book one for them there and then and then proceed to take them once the job is called out? Would that be about right?

If they ask me to book a cab/car then I will. And if the office send me a job cos I'm first on the plot/zone, then I will take it.

If I'm not first, then I will wait with them till one of the lads arrive.

If they ask if they can get in without all that messing about, then I will say no.

If they are pi**ed up, or look iffy, then I will point them to the nearest rank.

Clarification please on PHV bookings, we are told by our LA people that anyone can approach a PHV and as long as the driver radios the booking in before the passenger enters the vehicle then it is pre booked and no rules have been broken.I was always under the impression that PHV bookings could only be made via a land line telephone.

Where I differ from what's been said depends on what the customers asks for.

If he asks the driver if he is free and the drivers says yes, then IMHO that's illegal, but if he asks the driver if he can book him a cab through his office, then I think that's ok.

If then that driver is first on the point, then again IMHO, he is entitled to take the job.

So there.

I get the feeling you are on wind up here, Sussex.

But, if you are not, you will get a pull, sooner or later.

Does IMHO opinion stand for "In my honest opinion?" if it does, then an opinion, it may well be, but a thoroughly DIS-honest one. You can have your opinion if you like, but a Judges opinion will carry more weight, and a bigger fine, for illegally plying for hire, which you appear to be admitting. Shame on you.

The Eastbourne case will also give you an insight into illegal plying for hire?

Not in this case.

The issue of an illegal booking is not the same as illegally plying.

If you are saying that if a customer approaches me I'm illegally plying then that's one thing, but if I pass a booking to my office then how can that be operating? If that was illegal, then how many PH act illegally when asking for a second/third/fourth car, when the customers can't count?

Back to the plying issue, again where exactly do you expect PH to sit when not hired? Sadly we can't disappear. So if a customer approaches a driver, then in my most honest opinion if that driver doesn't take or attempt to take them then he can't be done for plying.

So there. :-$
