When I was diagnosed as diabetic, I rang the DVLA to tell them. When I said that it was controlled by diet and tablets, they said thank you for letting us know, I will put a note on your record. Job done. I rang my insurers and they said the same. No forms no doctors letter no problem.

As you say obviously the actions of an over-zealous licensing officer.

A friend of mine that had lost an eye was in the middle of a debate with the council, it was at the time they were bringing out the new rules governing Hgv and PSV licences regarding eyesight.... glasses etc.... vision .....

my friend had been driving a hackney carriage for four or five years prior,..... they seem to think that having only the one eye they should take away his licence and introduce their new policy.

I attended the meeting and stated.. that he had lost his eye in the Falklands. under fire,
a ricocheted had taken off half his face, and he had 26 operations reconstructing it, as far as the the DVLA were concerned he was fit to drive, so in my opinion it was OK for him to lay his life on the ground serving his country but the hackney officer didn't think he was fit to drive a Hackney vehicle, there were a few more choice words which I could not repeat, the outcome was he kept his licence and that particular part of the medical was not enforced.

PS. to this day he has never had an accident

=D> Totally agree with you T.Two of my relatives were diabetic,but they still had a healthy working life with no setbacks as they kept their diabetes controlled with diet/tablets etc.
I always remember a spurs footballer called gary mabbut who had diabetes and he never seemed to have any probs!

I hate to be the bearer of bad news but my friend lost his appeal at magistrates.
However he didn't employ a solicitor as he thought the jp's would be sensible and do the right thing.
He is planning an appeal to crown court and will use lawyers this time.

He is however going to offer the council a chance to not waste taxpayers money by asking them to reconsider their decision before running up a legal bill.

Any further help with documentation and / or case law would be gratefully received.

It's apparently a condition imposed by Reigate and Banstead Ccl

He has no problem with driving as the DVLA are OK with him and they would remove his lic. like a shot if they thought there was any danger.

It's presumably just some old prejudice that has been allowed to remain in place as a condition by the dinosaurs on that council, they are obviously embarrassed by it as they don't mention it on their web-site.

Thanks to all for your info.

The appeal is lodged, the solicitor on board.

Letter has been sent to Council to offer one last chance before they waste their ratepayers money on a Crown Court appeal.

ps the Magistrates didn't award costs against my mate in his original appeal so they presumably thought there was some merit in his case.
