Thats fairs do's Mr Badger, thats your choice not to wear a belt, you have the option, maybe as you get older, as I am. you maybe start thinking, do I need to live a little longer for the sake of a few quid job, or actions of your passengers who don't take safety as a prime concern in todays modern motoring of high tech vehicles, you never know whats round the corner, think about it, that p^ss head who runs across the road on a saturday night could end your life if you are not safety prepared, makes sense don't it, well it does to me, got more concerned as i got older

[
Fair do,s Pete, half of my post was meant in humour :) .But i am still not going to wear my seatbelt and can you honestly say that you make a fare get out of your car or cab if they do not put their belt on.
I didn't see that reply, here's my answer

no seat belt on by passengers or not willing to put one on, then they are history, cab stops and they are asked again, seatbelts on, refuse to belt up, then they are told to get out and find another mug who is willing to take them un restrained

yes I do work like that, we should all work like that, its called health and safety at work, would a truck driver set of with an unsecured load, no he would not, why should we

seat belt law is straight forward guys and we should all know what we can and cannot do. If we get caught not wearing it when we should be wearing it then we only have ourselves to blame. The best thing to do is try to explain it away at the scene of the incident.

Once you have been booked there's not a lot you can do about it.

Regards

JD

There must be some errors somewhere - too many brackets, or not enough or whatever.

If even one bracket or whatever is missing then it won't work.

I suppose that even if you're out of area in an HC you may have a job waiting when you get back in which case you're exempt as "answering a call for hire", however if there's no job waiting for you then the belt should be on.

However, I could see there being a lot of confusion in practice over the rule, and I wouldn't be surprised if police construed it as saying that if you're out of area without a passenger then you must the belt on.

As with many of the offences the police try to charge us with it comes down to what we tell them when stopped. Remember what you say can be used as evidence.
SO CAN WHAT YOU DON'T SAY.
If out of area (hack) and you tell them you are going to a job, you will probably be ok. If you don't mention this at the time and try to use it later, then you are probably up sh*t creek.
If you have accepted and signed for a fixed penalty ticket, you have probably already admitted the offence.
You do not have to accept a fixed penalty. If you do, it's an admission of guilt. This applies to all RTA offences.
If you think the police are wrong SAY SO! Very often they rely on you incriminating yourself.
Do not agree with them and state your case. Be polite, don't lose your cool and stick to your guns. 8)
In the last 5 years I have been stopped twice for speeding and twice for jumping red lights. I wasn't charged on any of these occasions and still have a clean licence. Touch wood. :)

If they are serious about charging you then weigh it up.
If they think your being difficult, they can always give your motor a going over. Tyres, lights, brakes etc. Is it legal?
If it goes to court (which many don't) the fine will probably be more if you lose.
If it's just a fine with no points You might be safer to take the fixed penalty and cut your losses.
Points will cost you dearly for insurance over the next few years and could cost you your licence, now or later.

Make up your own mind.
