Small PSVs subject to regulation as private hire vehicles.

If a small bus is being provided for hire with the services of a driver for the purpose of carrying passengers otherwise than at separate fares, it is not to be regarded as a public service vehicle for the purpose of (1) the Local Government (Miscellaneous Provisions) Act 1976 Pt II, or (2) any local Act applying in any area in England and Wales which regulates the use of private hire vehicles provided for hire with the services of a driver for the purpose of carrying passengers and excludes public service vehicles from the scope of that regulation.

If a small bus is being made available with a driver to the public for hire for the purpose of carrying passengers otherwise than at separate fares, it is not to be regarded as a public service vehicle for the purpose of the Private Hire Vehicles (London) Act 1998; but the provisions above do not apply where the vehicle is being so provided or made available in the course of a business of carrying passengers by motor vehicles all but a small part of which involves the operation of large buses.

1 In the Public Passenger Vehicles Act 1981 s 79A 'small bus' means a public service vehicle within s 1(1)(b) (see para 818): s 79A(4) (s 79A added by the Transport Act 2000 s 265(2)).

2 For the meaning of 'public service vehicle' see para 818.

3 Ie the Local Government (Miscellaneous Provisions) Act 1976 ss 45–80. As to the application of Pt II see para 1054.

4 1981 Act s 79A(1) (s 79A as added: see note 1 supra).

5 Ibid s 79A(2) (s 79A as added: see note 1 supra). As to the Private Hire Vehicles (London) Act 1998 see para 1120 et seq.

6 Ie the 1981 Act s 79A(1), (2) supra.

7 Ibid s 79A(3) (s 79A as added: see note 1 supra). In s 79A 'large buses' means public service vehicles within s 1(1)(a) (see para 818): s 79A(4) (s 79A as so added).
