So why are you ignoring my question then?

I repeat, is it possible for a convicted rapist and/or murderer to legally drive a limo under the self-drive scheme?

Well plenty have carried on after being convicted of violence etc and not packed up until their licenses have been revoked

But that's missing the point - you claimed that the CRB system and the DPA would be a bar to the the licensing authority even having knowledge of any offence while the driver had a valid badge?

JD are you sugesting that when a customer hires one of these 16 seat limousines and he asks "where can I get a chauffer" the person hireing the vehicle would have to say to them "I can't tell you that, you will have to sort that out for your self." or could he say "here is a list of agencies that provide chauffeurs, you could try any of them."
What probably couldn't be said is "here is a list of agencies but I recomend that you use XXX."
But I don't fully know the system.

So you're saying that generally speaking under the self-drive scheme the driver of the limo is unknown to the owner of the limo?

I can't see the relevence of if the driver is known or unknown. As long as there is no link it does not matter.
Have you ever had a punter ask you if you know where he can get a prostitute? If you then tell him are you then linked to the prostitute?

Well what I'm getting at is whether the self-drive scheme is supplying genuinely independent third-party drivers or whether the whole thing is a legal sham.

You say "as long as there is no link", but what do you mean by link precisely?

I suspect you're referring to the legal form of the relationship rather than the substance.

Ie on paper the driver and owner are unrelated, but in reality the driver is under the control of the owner.

Probably depends whether it's a prostitute or any prostitute.

The limo industry has to self regulate to a point BECAUSE there is no correct legislation that fits us at the moment.

You still believe MP,s control the country

If they didn't then I can assure you 100% of councils would have de-limited their taxi fleet following the OFT taxi study.

But they do, and the DfT didn't.

Ofcourse they do!

Where in legislation does it state, or imply, that limo drivers need to be CRB checked?

And who checks them if they are, the un-licensed operators? :?

No No No, the operator is allowed to recommend agencies but not DRIVERS nor can he stipulate any particular agency.

When you say operator I assume you mean owner? :?

TDO please note that GRANDAD admits that he doesn't fully know the system, much like myself, but then we are clearly 8 and under so why would we!!

Well everyone connected to the taxi/PH/PSV trade should go out of their way to find out about this scam.

And then make sure it ends.

Well that's not the case.

Once legal I couldn't give a monkeys, but untill then I do care, and I think the law is what licensed folks should be adhering too, not ignoring it cos it's a little bit difficult.
