Post subject:  More Fun In York
A hackney owner turns up for a test with a brand new 407 estate, " Sorry its failed they said, the tailgate window is too tinted it will have to be changed."
So at a cost of £350 it is changed to allow a licence to be isued, when asked why the shed on wheels of aPHV is allowed to operate with CURTAINS at his rear window the answer was there is no legislation on curtains.

Didnt we have this CURTAIN thing about six months ago??
he wants to complain about the half dozen or so hackneys with BLACKED out windows working in york

He questioned this and was told that as they are already licensed they can stay on until renewal then they too will not be allowed on with blacked out or excessivly tinted windows, but still the curtain guy roams free for as long as he wishes.

The way councils must legally work is that they can't ban someone from doing/having something unless there is a written rule to allow them to do so.

It would appear York are the only council in the country that adhere to that. :roll: :roll:

That is rubbish i know at least one PH driver who after his car had passed the council test was called in because the rear window of his 807 is tinted had to get it changed, after being GRASSED up by another driver.
York taxi licencing make the rules up as they go along

So you mean it was curtains for the tints, but not curtains for the curtains. :)

A council may say "yea" or "nay" to curtains if they wish. They don't need an act of parliament to do so as they already have that power bestowed on them, as sussex rightly says.

If anyone sees this chap who is taking York council to court will you please ask him to come on TDO so that I and perhaps others can give him some valuable advice on conducting his case.
