there appears to be a traned starting were you are not taken to court, but the police feel that, we will put this on a CRB, THEN THE COUNCIL SEE IT they may take you licences. or you have been found not guilty by your peers. which the police off so they put it on your crb.

you apply for a dispute with the crb the police say it as to say ? what can you do then.

I think I can translate... it is an obscure variation of the Bolton dialect..
Translation.... I am led to believe that a person charged with an offence, but is not prosecuted can still have the circumstances of this charge passed over to the CRB by the police, is it correct that when the council apply for your CRB check this information might lead to the applicant being refused even though he never went to trial,
when appealing this with the police they informed me it is normal practice.

Can anyone advise me if this is correct.

I hope I have been of assistance....... and happy new year charlie. :wink:

The police can only put a caution/conviction on a CRB if the driver admits the offence.

The courts can only put a conviction on a CRB if the driver either admits his guilt or is found guilty in court.

However the new rules coming out next October will mean something can go on the new safety checks even if the police just suspect you of doing something.

what happened to "innocent till PROVEN guilty"?

the EU courts can demand destruction of the UK police DNA database (which has caught murderers and rapists many years after the event) but let suspects get a criminal record?

My sister bought "my Cooka Choo" by Alvin Stardust...............now that is a criminal record. :mrgreen:

The CRB check not only checks to see if you have a criminal record,it also takes into account a Chief Constable comments.
I haven't got my CRB form to hand but I have know doubt someone will post the exact phasing.

For example, you are charged with armed robbery but a witness for the prosecution doesn't appear and the case against you is dropped,the Chief Constable may make a record and it will appear on any CRB check.
I hope this is clear.
Yes you are innocent until proved guilty,but Al Capone was only convicted for tax evasion...

I don't know if many people have heard of the National Police Records (Recordable Offences) Regulations 2000 but thats what your up against.

Convictions for cautions, reprimands and warnings in respect of, any offence punishable with imprisonment may be recorded in national police records. There may also be recorded in those records convictions for, cautions, reprimands and warnings in respect of a host of minor offences.

If the person who is enquiring received any of the notices mentioned then it would indeed be recorded. The police can object to any license application but they cannot manipulate criminal records.

I believe I did post the list of minor offences quite some time ago.
