Post subject:  Hackney Carriage Firm working as Private Hire

There is a large taxi firm who operate in the ditsrict next to mine and all there vehicles are HC. They have their own bookings office and do a lot of phone bookings.

They are accepting a lot of phonebookings to do a pick up and drop off soley in my district when they are not licensed with my council.

I know PH can do this. Surely HC can't be doing this, there getting the best of both worlds, and also getting trade from 2 districts on a regular basis - fair enough if its occasionally, I just think their taking work off the lads who are licensed for HC in our district.

Any guidance or thoughts would be most appreciated.

Are they committing any offences?

A HC can accept any booking which either starts or ends in the area to which he is licensed.

A PH operator can accept any booking anywhere in the country providing the vehicle and driver are licensed in the same area as the operator.

Taxis were here long b4 private hire, in fact private hire was never envisaged.

lol Charlie, Hackney carriages can pick up and drop off in any area they are called to. For example if I phoned an out of town Taxi firm to come and pick me up in Manchester and drop me off in manchester they are quite entitled to do that. Both Hackney and private hire can do that as long as the call was taken in the area where the operator is licensed.

Now here's a point for you, the latest court case regarding this matter has made it clear that Taxis are not regulated by the operators licence that regulates Private hire operators so it could be the case that a Taxi booking agent can take a booking from anywhere in the country, something which Private hire cannot do.

How about that one?

Just to put some meat on the bones Charlie heres what Justice Collins said in the recent Gladon case.

I have reached the clear view that the district judge in this case was correct and that section 46(1)(d) is not breached where a licensed hackney carriage and a licensed hackney carriage driver is provided for the relevant conveyance of a passenger, albeit it is provided through an operator. In those circumstances, an operator's licence under section 55 of the Act is not appropriate, since that section does not cover hackney carriages.

So in effect he is saying the council have no jurisdiction over Taxi drivers when it comes to taking private bookings. So one would assume following on from that, that it would be possible for a person or agent to take booking from anywhere in the country, for me here in manchester. How about that one? lol

It's just pleasing to know that a PH firm must be run by a 'fit and proper' person. Whereas anybody, even Attila the Hun, can run a taxi firm. :shock:

I just find it amusing that it's now safer to travel with a 'fit and proper' PH operator. :D :D

The punters couldn't care less especially this time of the year, as long as they get home and it don't cost an arm and a leg, AND YOU CAN DO IT NOW!!!!

This guy, a president of a multinational farted in my merc today and didn't even excuse himself, it's the only noise ive heard from him in the 3 years I have been taking him :D

That private hire firm you mention, just happen to be the biggest hackney carriage firm (Comcab) in the UK. :shock:
