A pedestrian who was knocked down and injured by a taxi as she crossed a Stratford High Street in north London, is to receive compensation after it was ruled that the local council was partly responsible. Pervin Yetkin, 54, was on her way to play bingo when she crossed a road with the traffic lights against her in February 2004. She was hit by the taxi and suffered life-threatening injuries including a fractured neck and internal bleeding, Mrs. Yetkin claimed that her view of the oncoming traffic was obstructed because of an unmaintained hedge. After a four-year legal battle, Mrs. Yetkin, 54, successfully appealed against an earlier ruling that she was not entitled to claim compensation because she was substantially to blame for the night-time accident in February 2004. The court of appeal has now concluded that Newham Council must pay compensation for 25 per cent of her injuries because it had a care of duty to maintain the hedge properly. Consequently, the appeal judges Lord Justice Laws, Lady Justice Black and Lady Justice Smith dismissed last year’s decision that Newham Council were not responsible and did not owe Mrs. Yetkin a duty of care, and that the previous judge in the earlier ruling had misunderstood the law. The compensation to be awarded will be decided at a future date. |

for substantially read totally crossed a road despite a red light was she nicked for jaywalking? must be some bush - i love a hairy bush |
