In the current climate of "we're reviewing our policies" and "new legislation is long overdue to replace outdated Hackney and Private Hire Laws", etc, I wondered if you guys could help me out with a "survey" on the use of the word TAXI in advertising?

can you go to www.comparethetaxi.blogspot.com

and leave a comment of two please? could you also be kind enough to state whether you are Hackney or Private Hire or a non-licensed member of the public? Thanks.

The only people moaning are taxi drivers trying to protect something they lost decades ago.

Punters who want to go from a to b in a licensed vehicle couldn't give a dam if it's a ph or hackney carriage.

Times have changed, and if the law commission and certain section of the licensing system have their way, then we will all be taxis.

One big fat happy family.

Taxis sit on ranks

PH race around collecting passengers when they call...

I'm well aware of what they are, thankyou. I've been in the trade for some 20 years, as both a hackney and private hire driver.

What i'm trying to establish is the use of the word TAXI, what it actually means to the public......

If you want to know what the word taxi means to the public, you should be asking the public.

Indeed - but it would seem the public are totally disinterested, which is exactly as I predicted.

It would appear the only people interested in whether or not the word "TAXI" is used by a private hire company or not, are the hackney drivers of the UK. Even our local licensing department don't see the point of it.

I think the use of the word TAXI by PH's should be allowed.

Its what everybody calls them anyway.

Its like using the Word Hoover, even though you might be using a VAX vacuum cleaner.

You really should be careful what you wish for.

So do I, provided they comply with the same licensing conditions for cab and driver.

Let's face it, PH have had 36 years to educate the public as to what a PH is and isn't and to forge a separate identity.

The time has been wasted because they have spent the 36 years trying to convince the public they are taxis.

Joe or Josephine Public really dont care....If they want to call my Business a Taxi then thats fine, My PH persona will not take umbrage. Hell !...they could even ask if I'm the Tvvat that Takes people places for money and I'll still take their money off them.

It's What I can do for them that matters and not what Title I go by.. :?

CGSA 1982
Quote:
23(1) In sections 10 to 22 of this Act:-
“taxi” means a hire car which is engaged, by arrangements made in a public place between the person to be conveyed in it (or a person acting on his behalf) and its driver for a journey beginning there and then; and
“private hire car” means a hire car other than a taxi within the meaning of this subsection.

(2) In subsection (1) above, “hire car” means a motor vehicle with a driver (other than a vehicle being a public service vehicle within the meaning of section 1(1)(a) of the Public Passenger Vehicles Act 1981) which is, with a view to profit, available for hire by the public for personal conveyance.
(3) Notwithstanding that a vehicle in respect of which there is a licence for its operation as a taxi is, on any occasion, engaged as a hire car otherwise than in the manner referred to in subsection (1) above, the enactments relating to its operation as a taxi and to the driving of it as such (including any such enactments in this Act) shall nonetheless apply in relation to it; and that other manner of engagement on that occasion shall not of itself cause the operation or driving of the licensed taxi to be regarded for the purposes of this Act as the operation or driving or a private hire car within the meaning of subsection (1) above.

The Scottish legislation is quite clear: A PH is not a taxi.
To advertise it as such would be IMHO illegal.

The word taxi is not defined in English law, as far as I'm aware.
Perhaps something for any new cab act to do?

Purpose-built Hackney's come with the word taxi in the roof light as standard..... the danger of wrongly educating the public that private hire are taxis is that it leaves the public believing that they can flag down a private hire vehicle in the street. which then means private hire drivers are committing an offence, councils especially have a duty of care to make sure this does not happen.....

It's top of my list as are definitions for 'Taxi', 'Hackney Carriage', Private Hire Vehicle', 'Private Hire Operator', 'Taxi Driver', Hackney carriage Driver', 'Private Hire Driver' and a definition for anything else that the new Cab Act might deem should be licensed.

You might think that is taking it to the extreme, but if you define all these, then prosecutions for contraventions should be so much simpler than at present.

Some local authorities have outlawed PH companies from using the word taxi in advertising.......my good friend Charles 007 was very successful in Burnley (or Bunly) in doing this....by getting the conditions attached to the PH Operators license changed.

As for the question should PH be able to call themselves Taxis........certainly not.
